87468.2(a)(4) PERSONAL RIGHTS …Residents in privately operated residential care facilities for the elderly shall have all of the following personal rights: To care, supervision, and services that meet their individual needs and are delivered by staff that are sufficient in numbers, qualifications, and competency to meet their needs. This requirement was not met as evidenced by: Based on record review and interview, the licensee did not comply with the above cited section when R1 eloped from the facility sustaining a fall and injury which posed an immediate health and safety risk to residents in care.

Safe, healthful, comfortable accommodations

87468.1(a)(2) Personal Rights of Residents in All Facilities ...To be accorded safe, healthful and comfortable accommodations, furnishings and equipment.This requirement was not met as evidenced by: Based on LPA’s observation, the licensee did not comply with the section cited above as LPA observed 3 out of 4 laundry room cabinets with First Aid kit signage posted but no First Aid kits were observed in the cabinet(s) which poses an immediate health and safety risk to residents in care.

87211 Reporting Requirements (a) Each licensee shall furnish to the licensing agency such reports...(1) A written report shall be submitted to the licensing agency and to the person responsible for the resident within seven days of the occurrence of any of the events specified ... (D) Any incident which threatens the welfare, safety or health of any resident...This requirement is not met as evidence by: Based on record review and interviews, the loss of R1’s eyeglasses and wristwatch were not reported to R1’s responsible party or to CCL which poses an immediate health and safety risk to residents in care.

87218 Theft and Loss (a) The licensee shall ensure an adequate theft and loss program ... (2) A licensee who fails to make reasonable efforts to safeguard resident property, shall reimburse a resident for or replace stolen or lost resident property at its current value. ...This requirement is not met as evidenced by: Based on record review and interviews, R1’s personal eyeglass and wristwatch were lost when R1 was sent to the hospital following a fall. This poses an immediate health and safety risk to residents in care.

Report specified resident events within seven days

Reporting Requirements: …(1) A written report shall be submitted to the licensing agency and to the person responsible for the resident within seven days of the occurrence…This requirement is not met as evidenced by:*THIS IS AN AMENDED REPORT OF THE ORIGINAL REPORT DATED 6/29/2021. Based on records reviewed and interviews conducted, facility staff did not report falls R1 sustained resulting in serious injuries on 1/9/2021, 1/17/2021 and 6/20/2021 which poses an immediate health and safety risk to residents in care.

Notification to department after hospice care starts

Hospice Care Waiver: The licensee shall notify the Department in writing within five working days of the initiation of hospice care services for any terminally ill resident in the facility...This requirement is not met as evidenced by: Based on records reviewed and interview conducted, facility staff did not notify CCL of R1’s hospice placement on 1/9/2021.
