What the inspector wrote

Based on the evidence obtained, it was determined that the facility is operating out of ratio. Based on the interviews and information obtained throughout the investigation, the preponderance of evidence standard has been met. Therefore, the allegation is SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Section 102416.5 is being cited on 9099-D page. A Type A deficiency was cited during this inspection. Licensee must provide a copy of this report to all parents of children currently enrolled, and the parents of newly enrolled children in the next 12 months. In addition, form LIC 9224 (Acknowledgment of Receipt of Licensing Reports) must be signed by each parent and placed in each child's file. A copy of the LIC 9224 and AB 633 fact sheet were provided to the Licensee during the inspection. Exit interview was conducted with Patricia Sorto. Appeal rights were provided. A NOTICE OF SITE VISIT WAS ISSUED AND MUST BE POSTED FOR 30 CONSECUTIVE DAYS. Based on the evidence obtained, it was determined that the facility is operating over capacity. .   • STAFFING RATIO AND CAPACITY

    (a) The capacity specified on the license shall be the maximum number of children for whom care may be provided at any one time.This requirement has not been met as evidenced by observations and interviews. The facility had 11 infants in care today. This poses an immediate risk to the health and safety of children in care.

  • 102416.5(b)(2)Type A

    (b) For a Small Family Child Care Home, the maximum number of children for whom care may be provided at any one time, including children under age 10 who reside at the licensee's home, shall be one of the following:(1) Four infants; or This requirement has not been met as evidenced by observations and interviews. 11 infants were observed in care during the inspection. This poses an immediate risk to the health and safety of children in care.

  • CRIMINAL RECORD CLEARANCE

    (d) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing, or volunteering in a licensed facility:(1) Obtain a California clearance or a criminal record exemption as required by the Department or This requirement has not been met as evidenced by observations and interview with the licensee. One or more persons did not obtain a criminal record clearance and was caring for children. This poses an immediate risk to the health and safety of children in care.

    PERSONNEL REQUIREMENTS

    (c) The licensee and other personnel as specified shall complete training on preventive health practices, including pediatric cardiopulmonary resuscitation and pediatric first aid, pursuant to Health and Safety Code Section 1596.866. This requirement has not been met as evidenced by document review and interview with the licensee. Assistants caring for children alone don't have current CPR/First Aid certificates.This poses a potential risk to the health and safety of children in care.

    (D) Documentation shall be maintained in the infant’s file and be available to the Department for review. Documentation shall include the following:a. Date.b. Infant’s name.c. Time of each 15-minute check This requirement has not been met as evidenced by observations and interview with the licensee. MIssing infant sleep logs for infants in care. This poses a potential risk to the health and safety of children in care.
