What the inspector wrote

The administrator and the five staff interviewed, stated that they assist all residents in a timely manner and usually respond within 10 minutes. Six out of the ten residents interviewed, stated that it takes about 30 minutes to an hour for the resident in question to get assistance. Three out of the ten residents interviewed, stated that staff assist the resident in question in a timely manner. Based on LPA's interviews which were conducted, the preponderance of evidence standard has been met, therefore the allegation is found SUBSTANTIATED. California Code of Regulations Title 22, Division 6, and Chapter 8 are being cited on the attached LIC 9099D. Exit interview held and a copy of the report and appeal rights was provided. During the tour the LPA did not observe any residents hanging out in the parking structure and the gate to the parking structure was locked. LPA observed residents hanging in the garden area. Interviews conducted with staff revealed that no residents hang out in the parking structure. Interviews conducted with residents revealed that they do not go in the parking structure and they hang out in the garden area. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.
