The administrator and staff also stated that S2 is physically attacked by one of the residents in that shared bedroom whenever S2 attempts to go inside to clean. S2 has to wait until the resident leaves the room in order for her to rush in there and clean. The smeared feces in the bathroom was cleaned on 07/08/22 because the resident went on an outing and S2 took this opportunity to finally clean the bathroom and also the bedroom. Interview conducted with the roommate revealed that S2 is physically attacked and the other resident does not allow the staff to do their job and clean their room or bathroom. Interviews conducted with other residents revealed that S2 does a good job in cleaning their rooms and bathrooms and has never refused to do so. LPA toured the facility and observed that the bathroom in question is clean. LPA also observed S2 and other staff cleaning other bedrooms and bathroom. Regarding the allegation " staff is retaliating against resident for complaining ", it is alleged that S2 was the one that smeared the feces in the bathroom because S2 is angry at the resident for complaining. The administrator and staff interviewed denied this allegation and stated they don't know who smeared the feces. Interview conducted with the roommate revealed that S2 was not the one that smeared feces in their bathroom. The smeared feces was accidentally done by the roommate. The roommate did not notified the staff when it happened because the staff would have noticed when they do their routine cleaning, but the feces lasted there for about 3 days because the other resident in that bedroom was not allowing S2 or any of the staff to go in the room or bathroom to do their routine cleaning. The other resident physically attacks the staff when they enter to clean. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.
