87224 Eviction Procedures (a) The licensee may evict a resident for one or more of the reasons listed in Section 87224(a)(1) through (5). Thirty (30) days written notice to the resident is required...This requirement is not met by: Based on the LPA's Interviews the licensee/administrator failed to ensure that resident #1 (R1) was not given the proper 30 (thirty) day notice for eviction. R1 was not allowed back to the facility after hospitalization discharge. This posed an immediate health and safety risk to residents in care.

Assist residents with self-administered medication

87465 Incidental Medical and Dental Care (a) A plan for incidental medical and dental care shall be developed...provide for assistance in obtaining such care, by compliance with the following:(4) The licensee shall assist residents with self-administered medications as needed. This requirement is not met by: Based on the LPA's Interviews the licensee/administrator failed to ensure that resident #1 (R1) was being provided all their medication. This posed an immediate health and safety risk to residents in care.

No stage 3 or 4 pressure injuries

Prohibited Health Condition (a) Persons who require health services for or have a health condition including, but not limited to, those specified below, shall not be admitted or retained in a residential care facility for the elderly: (1) Stage 3 and 4 pressure injuries. This requirement is not met as evidenced by: Based on interview and record review, the licensee did not ensure that R1 was not retained with a Stage 3 or 4 pressure injury and received proper treatment of the pressure injury, which posed an immediate health and safety risk to residents in care.

87609(B)(4) The licensee and home health agency agree in writing on the responsibilities of the home health agency, and those of the licensee in caring for the resident’s medical condition(s).This requirement is not met as evidenced by: Based on observations and interviews, the facility did not ensure that a written record of the Home Health agreement for wound care of R1 was kept at the facility which poses an immediate risk to residents in care.

87621(b)(1)(B) There shall be written documentation by an appropriately skilled professional outlining the instruction of the procedures delegated and the names of facility staff who have been instructed.This requirement is not met as evidenced by: Based on observations and interviews, the facility did not ensure that written documentation of the colostomy care being provided by Home Heatlh was kept on file which poses an immediate risk to residents in care.
