What the inspector wrote

Licensing Program Analyst (LPA), Angela Panushkina, conducted a CASE MANAGEMENT visit and met with an Executive Director. LPA explained the reason for the visit. During the visit, made on 09/01/22, LPA was informed that several incidents took place between 08/03/2022 to 08/22/2022 and were not submitted to the Community Care Licensing Department (CCLD) in a timely manner. Based on Title 22 Regulation: a written Unusual Incident / Injury Report shall be submitted to CCLD within seven (7) days of occurrence. LPA informed Executive Director that all staff members are mandated reporters and they are all responsible for reporting. On 09/02/22, LPA received twelve (12) incidents that occurred on following dates: 08/03/22 (one incident) 08/04/22 (one incident) 08/10/22 (one incident) 08/17/22 (two incidents) 08/18/22 (two incident) 08/19/22 (one incident) 08/20/22 (one incident) 08/22/22 (three incidents) Per the California Code of Regulations, Title 22, Division 6, Chapter 8, deficiencies are cited and noted on LIC 809D. Exit interview conducted, appeal rights and copy of report given emailed to the Executive Director.

(1) A written report shall be submitted to the licensing agency and to the person... ... any of the events specified in (D)...This requirement is not met as evidenced by: Based on interviews and record reviews, conducted by LPA during the visit made on 09/01/22, the licensee did not comply with the section cited above by failing to notify residents responsible party (in writing) about the incident within seven (7) days of the occurence, which poses a potential health and safety risk to persons in care.

(6) Without violating Section 87468, Personal Rights, facility staff shall ensure the continued safety of residents...This requirement is not met as evidenced by: Based on interviews and record review, the licensee did not comply with the section cited above by failing to ensure the safety of resident who wondered away from the facility, which poses an immediate health, safety and personal risk to persons in care.
