Inspector’s narrative

What the inspector wrote

Administrator stated that she is aware that R1 and R2 smoke marijuana when out in the community but not in the facility . Per Administrator no resident has a medical marijuana prescriptions. On 8/18/23 LPA interviewed R1-R4, per R1 stated that he smell marijuana on a daily basis and has reported several times to "Roxanna and Ana", and was told there is nothing staff can do about it. LPA interview R2-R4 who denied the allegation. On 8/18/23 LPA interviewed staff #1-2 (S1-S2). S1 reported that S1 has never witnessed R2 smoking weed but S1 has smelled it on him. S1 states that R2 has no income and if he is smoking R2 is probable finding it outside but resident does smoke cigarettes when peers give him one. When asked if S1 has ever witnessed anyone smoking in doors S1 stated S1 Never seen anyone but I have smelled it and called Admin. and Admin speaks to resident(s) in the room are spoken too. When interviewed, S2 reported S2 hasn’t seen anyone smoke marijuana indoors but has found capsules in the trash can, takes a picture and reports to Admin. S2 stated that R2 has smelled of marijuana but has never seen him doing so, S2 also stated that R1 smokes cigarettes but does not know about marijuana usage. on 8/18/23 LPA reviewed R1 and R2 facility files, and there was no documentation within the file that indicates R1 and R2 smokes marijuana in the facility. LPA reviewed facility file which includes house rules, house rule #5, #7 and #21 state, (#5) "use of illegal substances is strictly prohibited while residing at the facility. This includes smoking marijuana within 20 feet of facility premises. House rule #7 states, there is absolutely no smoking in the building. smoking is permitted only in the designated outdoor area located outside at the back of the facility. House rule #21 states residents shall not be allowed to have anything with an open flame. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is Unsubstantiated. Exit interview conducted with Administrator Khatera Bahadory and a copy of this report was provided.
