What the inspector wrote

Licensing Program Analyst (LPA) Christian Gutierrez conducted the annual inspection using the Compliance and Regulatory Enforcement (CARE) tools. LPA met Assistant Administrator Rebecca Sinclair approximately 1:14PM and explained reason for visit. Administrator Michelle Aguirre arrived shortly. This facility is a Residential Care for Elderly (RCFE) to serve residents for age 60 and above. The capacity is six (6) non-ambulatory residents. Hospice waiver was approved for six (6). The facility is a single-story building in a residential area with three (3) resident bedrooms, two (2) shared bathrooms, kitchen, dining room, living room, den/tv room, front yard, backyard and attached garage. LPA observed two (2) rooms built in garage no permits provided. All resident bedrooms were toured. Each bedroom has a bed, linen, dresser, and lighting. Smoke detectors/carbon monoxide detectors were observed in each room and throughout facility. Cleaning supplies and toxic substances are inaccessible locked in garage. Freezers are maintained at a temperature of 0-degree F and the refrigerators at a maximum of 40 degrees F. Sufficient supply of 2 days perishable & 7 days non-perishable foods was observed in the kitchen. LPA observed scissors in unlocked kitchen drawer. There are no firearms or weapons stored at the facility The resident bathrooms have the required grabs bars and non-skid mats. The hot water temperature in the bathrooms were measured between the required range of 105-120 degrees F. The common areas include the living room and dining area are clean and have the required furniture. The facility does not have a swimming pool or large body of water. There is a shaded seating area for the residents in back yard. Passageways and exits are free of obstruction. SEE LIC 809C Four (4) staff files were reviewed and included Criminal clearance record, and health screening with TB, and CPR/First Aid certificates. Six (6) resident files were reviewed and were missing the following: R2 was missing TB, and R3 was missing updated physicians report (602). Last fire/earthquake drill was conducted in May of 2025. Infectious control plan was reviewed. Resident medications were reviewed, and no discrepancies found. Medications are centrally stored and locked MAR log is used. Per California Code of Regulations, Title 22, and California Health and Safety Code, the deficiencies observed during the visit are documented on the LIC809D. Exit interview held and a copy of the report along with appeal rights were provided.

Physicians report with TB was incomplete on R2’s file, Administrator left home to gather additional paperwork and came back with TB information completed LPA asked for old physician’s report (602) and it was removed from R2’s file and could not be found. Fire extinguisher had not been serviced and showed a receipt of January 2022 Administrator came from home with generic tag and stated they had left at another facility. (picture taken). which poses/posed a potential health, safety or personal rights risk to persons in care.

    Based on record review, the licensee did not comply with the section cited above R2 did not have TB completed on physicians report, and R3 needs a new physicians report which poses/posed a potential health, safety or personal rights risk to persons in care.
