87468.2 Additional Personal Rights of Residents in Privately Operated Facilities (a) In addition to the rights listed in Section 87468.1, Personal Rights of Residents in All Facilities, residents in privately operated residential care facilities for the elderly shall have all of the following personal rights:(4) To care, supervision, and services that meet their individual needs and are delivered by staff that are sufficient in numbers, qualifications, and competency to meet their needs.This requirement was not met by: Based on interviews and record reviews, the facility did not provide supervision necessary for R1 on 03/01/2022 resulting in R1’s injuries, this poses an immediate health, safety, and personal rights risk to residents in care.

87461(a) (1-2) Mental Condition. The facility shall determine the amount of supervision necessary by assessing the mental status of the prospective resident to determine if the individual:(1) tends to wander; (2) is confused or forgetful; this requirement was not met as evidenced by: Based on interviews and record reviews, the facility did not provide supervision necessary for R1 on 03/01/2022 resulting in R1’s injuries, this poses an immediate health, safety, and personal rights risk to residents in care.

Based on Licensing Program Analyst Mario Leon, one volunteer required to be present in the facility did not have any personnel record relating to criminal clearance, the licensee did not comply with the section cited above, which poses/posed a potential health, safety or personal rights risk to persons in care

Based on Licensing Program Analyst Mario Leon, Three (3) out of four (4) locks required to remove accessibility to cleaning solutions were inoperable, the licensee did not comply with the section cited above, which poses/posed a potential health, safety or personal rights risk to persons in care.

Regular observation and documentation of resident changes

Observation of the ResidentThe licensee shall ensure that residents are regularly observed for changes in physical, mental, emotional and social functioning and that appropriate assistance is provided when such observation reveals unmet needs. When changes such as unusual weight gains or losses or deterioration of mental ability or a physical health condition are observed, the licensee shall ensure that such changes are documented and brought to the attention of the resident's physician and the resident's responsible person, if any. This requirement was not met as evidenced by: R1 sustained a hip fracture on 1/14/20 that subsequently required surgery and facility staff did not report injuries to facility administrator/ licensee until nearly 24 hours later. This poses an immediate hazard to residents in care.

Additional Personal Rights of Residents in Privately Operated Facilities To be free from neglect, financial exploitation, involuntary seclusion, punishment, humiliation, intimidation, and verbal, mental, physical, or sexual abuse.This requirement was not met as evidenced by: R1 sustained a hip fracture on 1/14/20 that subsequently required surgery and facility staff did not report injuries to facility administrator/licensee until nearly 24 hours later. This poses an immediate hazard to residents in care.
