What the inspector wrote

In regard to the allegation” Staff inappropriately took resident's call pendant away”. It is alleged that R1’s call pendent was taken away. During interview with Administrator, and staff five out of six stated that R1 has his/her pendent taken away for excessive calling. Staff stated that R1 would continually press the call pendent for no reason taking away care from other residents. It was stated that staff check on R1 frequently and that there is a pull string in restroom. During interviews with residents four (4) out of five (5) all had call pendants. R1 stated that pendent was lost and when asked staff for it back was told staff did not know where it was. Based on record review and interviews conducted, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. Deficiencies are being cited according to California Code of Regulations, Title 22 and Health and Safety Code. An exit interview was conducted with Health Service Director. A copy of the report and appeal rights were emailed printer not working.

Based on interviews/record review, R1’s call pendent was taken away due to excessive pushing. This posed an immediate health, safety, and personal rights risk to the resident.

    Maintenance and Operation (a) The facility shall be clean, safe, sanitary and in good repair at all times. Maintenance shall include provision of maintenance services and procedures for the safety and well-being of residents, employees and visitors. This standard is not met at evidence by:Interviewed staff indicated that ceiling leaks occur frequently during the Summer time as the HVAC (air conditioner) is being used. LPA observed water damage on ceiling tiles.
