What the inspector wrote

On 8/11/23 at 9:30 a.m. Licensing Program Analyst (LPA) B. Miranda arrived at the facility unannounced to conduct a case management. LPA met with Resident Care Director Kimberly Jones. LPA previously received an incident report regarding R1’s death but no death report was submitted. Department must be notified by the next working day and a Death Report must be submitted within 7 days of the occurrence. Resident files are to be retained for a minimum of 3 years following termination of service to resident according to Title 22, Division 6, Chapter 8, regulation 87506 Resident Records. Facility was unable to locate the death report for R1. This deficiency is citable according to Title 22, Division 6, Chapter 8. Exit interview was conducted and a copy of LIC809, LIC809D, and appeal rights were provided to Resident Care Director- Kimberly Jones .

This report shall include the resident's name, age, sex and date of admission; date and nature of event; attending physician's name, findings, and treatment, if any; and disposition of the case.(A) Death of any resident from any cause regardless of where the death occurred, including but not limited to a day program, a hospital, en route to or from a hospital, or visiting away from the facility.This requirement is not met as evidenced by: Based on observation/ interview/ record review the licensee failed to provide the Department with a death report for R1. This poses a potential health, safety, or personal rights risk to residents in care. Resident files are to be retained for a minimum of three years.
