Inspector’s narrative

What the inspector wrote

On 9/9/2024 Licensing Program Analyst (LPA) B. Miranda arrived at the facility unannounced to deliver the findings for the allegations listed above. LPA introduced herself and explained the reason for the visit. LPA met with Administrator (AD) Doderlein Anaya Fernandez. 1. The Department investigated the allegation: Staff did not prevent resident from harming themself while in care. Multiple interviews were conducted. LPA was not able to verify facility did not prevent resident from harming themself. LPA observed bedrooms with double beds have the beds against one side of the wall. 2. The Department investigated the allegation: Staff did not safeguard resident's personal possessions. LPA conducted interviews and reviewed records. LPA observed a signed and dated "Discharge" form by R1's family indicating R1's personal possessions were returned when R1 left the facility. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is unsubstantiated. Exit interview was conducted and a copy of this report LIC9099 was provided to Administrator.

LPA observed pictured which shows R1's hygiene needs were not being met. R1 was doubled briefed and soiled through their clothes.

    87211 Reporting Requirements(a) Each licensee shall furnish to the licensing agency such reports as the Department may require, including, but not limited to, the following:(1) A written report shall be submitted to the licensing agency and to the person responsible for the resident within seven days of the occurrence of any of the events specified in (A) through (D) below. This report shall include the resident's name, age, sex and date of admission; date and nature of event; attending physician's name, findings, and treatment, if any; and disposition of the case.This requirement is not met as evidenced by: Based on observation, interview, & record review the licensee did not comply with the regulation listed above which poses a potential health, safety, or personal rights risk to residents in care. AD indicated on the incident reports the family was verbally informed of the incidents.

This training and/or related experience shall provide knowledge of and skill in the following, as appropriate for the job assigned and as evidenced by safe and effective job performance:(3) Skill and knowledge required to provide necessary resident care and supervision, including the ability to communicate with residents.This requirement is not met as evidenced by: Based on observation, interview, & record review the licensee did not comply with the regulation listed above which poses a potential health, safety, or personal rights risk to residents in care. LPA conducted interviews and reviewed pictures which showed bowel movement in a double brief for R1. R1 was found by interviewees to have dried BM and smell of urine.

LPA observed the Administrator's small child to go in and out of R2’s bedroom while the roommate was being treated. During interviews LPA was informed the small child was in and out of R1’s room while they were not properly dressed and being changed.
