Based on information gathered, interviews and records review, the Department is unable to ascertain if the above allegation occurred as reported. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove or refute the alleged violation occurred: therefore, the allegation is deemed UNSUBSTANTIATED. An exit interview was conducted and a copy of this report was provided at the time of the investigation. Based on the Departments observations and information gathered during the investigation, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22 Division 6 was cited on February 2, 2022, in regards to this complaint. An exit interview was conducted with AD Mark Ryan Cruz and a copy of this report and appeal rights were left at the facility.
