What the inspector wrote

Licensing Program Analyst (LPA) Mary Rico conducted an unannounced case management visit pertaining to resident’s eviction notice. LPA Rico met with staff Juana Tidy and explained the purpose of the visit. The Administrator Ann B. Vito was contacted and informed about today’s visit. During today’s visit LPA Rico conduct staff interviews, tour the facility and review records. LPA Rico reviewed the 30day eviction notice that was served to resident (R1) on 2/5/2025 and discovered the eviction notice did not follow Community Care Licensing Eviction Procedures. The notice did not include the following: · A copy of the resident’s current service plan. · The relocation evaluation . · The right of the resident or resident’s legal representative to contact the department to investigate the reasons given for the eviction pursuant to Section 1569.35. · The contact information for the local long-term care ombudsman, including address and telephone number. · A statement if the Licensee pursues an unlawful detainer action, the resident must be served with a summons and complaint. · A statement that informs the resident that the Licensee cannot evict a resident who remains in the facility after the effective date of eviction unless the Licensee files an unlawful detainer action in superior court and receives a written judgement signed by a judge · Statement that resident has right to contest the eviction in writing and through a hearing. Based of on the information gathered today’s visit one (1) deficiency was cited per Title 22, Division 6, of the California Code of Regulations.An exit interview was conducted, and this report (LIC809) (LIC809D) was discussed on the phone with Administrator Ann B. Vito and a copy was provided to staff Juana Tidy.
