What the inspector wrote

Licensing Program Analyst (LPA), Armando Perez conducted a case management visit to the facility for the purpose of issuing deficiencies. LPA met with Executive Director Valeria Garcia and explained the purpose of the visit. During interviews and a record review on February 21, 2025, LPA became aware of an incident involving two clients in care. It was advised that on February 11, 2025, multiple staff members reported observing Client #1 inappropriately touching Client #2. Administration was informed of the incident. Information obtained from Executive Director, Valeria Garcia, stated that immediate action was taken. Executive Director stated staff separated the clients, notified their responsible parties, and develop a plan pertaining to increased supervision. Interviews with staff, residents, and additional witnesses corroborated the information. However, the incident was not reported to Community Care Licensing Division (CCLD) as required. Per CCLD guidelines, a special incident report must be submitted within seven days from the occurrence. LPA reviewed Special Incident Reports pertaining to the facility and did not find any documentation referencing the observations made regarding the behavior between C1 and C2. As a result, a deficiency will be cited. This violation of regulations may pose as a potential health and or safety risk to clients in care. An exit interview was conducted. A copy of this report, LIC 809-D , and Appeal rights was reviewed with the facility representative and a copy was provided.
