Food handling safeguards during storage and service

Based on statements provided to LPA regarding food services, the licensee did not comply with the section cited above in as the procedure for preserving food prepared at 12:00pm to be served at dinner did not meet department requirements for food safety by storing items prepared during lunch to be served at dinner in the microwave and not ensuring items are refrigerated which poses/posed a potential health, safety or personal rights risk to persons in care.

Onsite food stock levels for nonperishables and perishables

Based on LPA review of food items, the licensee did not comply with the section cited above as LPA has determine the facility did not have a 2 day supply of perishable foods which poses/posed a potential health, safety or personal rights risk to persons in care.

Based on LPAs review of staff records, the licensee did not comply with the section cited above as LPA reviewed two staff files that were not current with 20 hours of annual training and 8 of which must be dedicated to dementia care which poses/posed a potential health, safety or personal rights risk to persons in care.

Ensure hazardous items are locked and not unattended

Storage Space: Except as specified in subsection (b), the licensee shall ensure that disinfectants, cleaning solutions, poisonous substances, knives, matches, tools, sharp objects, and other similar items which could pose a danger to residents are in locked storage and are not left unattended if outside the locked storage. This requirement was not met as evidenced by LPA observations of paint cans stored in the back yard under an outdoor table which poses a potential health, safety and personal rights risk to residents in care.

Arrange appropriate medical and dental care

Based on LPA review of records and the FAR issued by Alta Regional center, the licensee did not comply with the section cited above as Staff did not document MAR appropraitely when medications were adinistered which poses/posed a potential health, safety or personal rights risk to persons in care.

Based on review of staff training, the licensee did not comply with the section cited above for one fo the four staff files reviews which poses/posed a potential health, safety or personal rights risk to persons in care.

Dignity in personal relationships

87468.1 Personal Rights of Residents in All Facilities (a) Residents in all residential care facilities for the elderly shall have all of the following personal rights: (1) To be accorded dignity in their personal relationships with staff, residents, and other persons.This requirement is not met as evidenced by: Based on interviews and records review, the Licensee did not ensure residents were accorded dignity by Staff (S1). S1 spoke to C1 inappropriately on 10/23/23. This poses a potential health and safety risk to residents in care.

Administrator - Qualifications and Duties. The administrator shall perform the following duties…(4) Recruit, employ and train qualified staff… (5) Provide or ensure the provision of services to the residents with appropriate regard for the residents' physical and mental well-being and needs. This requirement is not met as evidenced by: Based on records review, the licensee did not ensure client's medication reason of use is filed and direct care staff completes the competency-based training and testing as required. This poses a potential health and safety risk to clients in care.

Certified administrator requirements and substitute coverage

Based on interviews and records review, the licensee did not ensure the facility has an active certified Administrator. Administrator certificate for Renee Ates expired 9-20-22. This poses a potential health and safety risk to residents in care.

Ensure hazardous items are locked and not unattended

Based on LPA observations, cleaning supplies cabinets were left unlocked, which made cleaning toxins accessible to residents in care. This posed an immediate health and safety risk to residents in care.
