What the inspector wrote

LPA Mknelly interviewed the facility Administrator and kitchen personnel as well as received a copy of the facility's "Cannot transfer/ Able to transfer" list that was posted in the dining area on 3/11/22. It was found that a policy was in place that required R1 to move from her wheelchair to a dining chair. In order to inform staff of who is to be transferred for meals, a list was posted thereby divulging personal private information about a resident to others. LPA informed Administrator and kitchen staff that both the required seating and the public list were both violations of personal rights. The list was removed to a place only viewable by staff and alternative seating arrangements were to be instituted by the facility. As a result of this investigation, LPA finds allegation to be (S) Substantiated - A finding that the complaint is Substantiated means that the allegation is valid because the preponderance of the evidence standard has been met. The following deficiencies were cited on 9099-D, per Title 22 Regulations, Division 6. (A)This poses an immediate Health and Safety risk to clients/residents in care. (B) This poses a potential Health and Safety risk, or personal rights violation, to clients/residents in care. Report reviewed with . Copy of this report and appeal rights provided. As a result of this investigation, LPA finds allegation to be (US)Unsubstantiated - A finding that the complaint is Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred. Exit interview with administrator.
