What the inspector wrote

On May 19, 2022 at 2:50PM, Licensing Program Analyst (LPA) Chris Hopkins arrived at the facility unannounced to conduct a case management visit regarding a deficiency from a complaint investigation that was investigated on 1/21/22. LPA met with Executive Director (ED) Mike Talani and explained the purpose of the visit. Per the video evidence, the caregiver found Resident 1 (R1) asleep in his/her recliner. Caregiver then raised the footrest of the recliner. When the R1 woke up a little later, he/she tried to get out of the recliner, but was unable to due to the caregiver putting the foot rest up, and R1 was unable to put the footrest down. R1 kept trying to get up and eventually fell out of the recliner, causing him/her to fall out of the recliner. The following deficiencies cited on the following 809D pursuant to title 22 rules and regulations, health and safety code. Appeal rights were printed and given to facility staff and Exit Interview was conducted.

    87608 Postural Supports (a) Based on the individual's preadmission appraisal, and subsequent changes to that appraisal, the facility shall provide assistance and care for the resident in those activities of daily living which the resident is unable to do for himself/herself. Postural supports may be used under the following conditions. (1)Postural supports shall be limited to appliances or devices such as braces, spring release trays, or soft ties, used to achieve proper body position and balance, to improve a resident's mobility and independent functioning, or to position rather than restrict movement including, but not limited to, preventing a resident from falling out of bed, a chair, etc. This requirement was not met as evidenced by: based on video footage the licensee did not ensure R1 was able to get out of the recliner after caregiver put the footrest up. This poses an immediate health and safety risk to residents in care.
