What the inspector wrote

Licensing Program Analyst (LPA) Bethany Mirlohi and Jacob Williams arrived unannounced and met with Administrator Kristine Clawson. A case management visit is being conducted today to issue citations and assess civil penalties. LPA's completed required COVID-19 testing protocols, and a daily self-screening questionnaire for symptoms of COVID-19 infection to affirm no COVID-19 related symptoms. LPA ensured they applied hand sanitizer before entering the facility and the following Personal Protective Equipment (PPE) was worn: N-95 Masks. Additionally, LPA was screened by staff upon entering the facility. During a review of the facility staffing roster, it was found that staff, Kandice Taylor was associated to the facility on 08/17/2021 and disassociated on 09/03/2021. After further investigation, it was learned that Ms. Taylor was not cleared to work and was denied an exemption from the Department on 03/23/2020. Based on the information, the facility allowed an individual to be employed and work with resident’s at the facility without being criminally record cleared. Citations are being issued today and civil penalties are assessed. Continuation on 809-C. On 09/10/2021, the Department substantiated complaint allegations for staff hit a resident while in care; staff inappropriately pulled a resident's hair while in care and staff mistreats a resident while in care. During the complaint investigation, it was learned that S2 observed S1 abuse R1 and failed to report the abuse as a required for a mandated reporter. Per WIC Section 15630(b)(1), S2 did not follow mandated reporter requirements. Citations are being issued for a mandated reporter failing to report suspected abuse. In addition, the complaint violations substantiated constitute physical abuse. Civil penalties in the amount of $500.00 are assessed today for a resident sustaining a serious bodily injury while in care. The facility is advised that a result of the serious bodily injury, the violation warrants a civil penalty assessment based on Health and Safety Code §1569.49. At this time, the civil penalty assessment is under review. LPA will return at a future date to assess a civil penalty if warranted. Appeal Rights given. Exit interview conducted.
