What the inspector wrote

Complainant alleges that the Provider did not provide adequate notice of fee increase to residents which is in violation of Health & Safety Code (H&SC) §1771.8(d). The Department interviewed the complainant, Bob Lange, former Resident Representative, and Kim Dominy, Executive Director – CdlC on July 17, 2023, July 18, 2023 and August 3, 2023, respectively and received the following documents: • Letter to CCRC residents dated 6/30/23 notifying of MCFI increase • Letter to non-CCRC residents dated 7/1/23 notifying of MCFI increase • Memo to residents dated 6/16/2023 notifying of 2023-2024 Budget Presentation Meeting • Budget Calendar Draft 2024 • Budget Presentation 2023-2024 • Resident Forum Summary dated 7/17/2023 Upon completion of review of information provided and interviews conducted, it was observed that the providers did notify the CCRC residents of the upcoming MCFI during the 2023-2024 Budget Presentation Meeting that was held on June 30, 2023. During the meeting the residents were also given a memo as of the same date outlining the amount of increase and implementation date which was August 1, 2023. This date complies with the 30-day requirement as set for by H&SC §1771.8(d). Additionally, the department was informed that there were two residents that did not fall under CCRC statutes (month-to-month agreements) and they received written notification on July 1, 2023 with an effective date of September 1, 2023, which complies with H&SC 1569.655. (a)/(d). Based on the review and investigation the Department finds the allegation “unsubstantiated”. Complaint finding were delivered via Teams and LIC 9099 was signed and emailed.
