Inspector’s narrative

What the inspector wrote

a review of licensing records, it was revealed, S1's finger prints were inactive and the clearance transfer was denied. S1 did not have criminal background clearance to work in a licensed care facility. According to interviews with outside sources and an admission by S1, S1 was hired and worked at the San Jose facility without criminal record clearance. Subsequently, the licensed facility received civil penalties due to Title 22 violation related to criminal record clearances. S1 left employment at the facility. LPA interviewed S1 regarding the aforementioned criminal record clearance where they referenced All for Senior. According to S1, S1 inquired with a friend who worked at All for Seniors in 2023. The friend told S1 to contact the licensee and gave S1 the licensee's telephone number. According to S1 and the licensee, the licensee told S1 to first obtain a criminal background clearance and contact them once it was complete. Admittedly, S1 did not follow through with getting a clearance and was not hired. S1 moved to San Jose where they were hired at the licensed facility previously mentioned. LPA again asked S1 did they ever work at All for Seniors facility and they said they did not. LPA interviewed the licensee and asked them did S1 ever work at All for Seniors. The licensee said S1 did not apply once they were told to obtain a background clearance. The licensee told LPA they are awaiting the results of S1's criminal record clearance as S1 is currently in the process of applying for a position. The Department has investigated the allegation that the f acility hired staff without criminal record clearance. Based upon record reviews and interviews, there is insufficient evidence to prove the allegation. The Preponderance of Evidence Standard was not met and as such, the allegation is Unsubstantiated. An exit interview was conducted with Licensee, Banting and a copy of the report and the Licensee/Appeal Rights (LIC 9058 03/22) were provided to Licensee, Banting, whose signature confirms receipt of receiving the documents.
