What the inspector wrote

Based on interviews and record review, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated.  California code of Regulations, Title 22, is being cited on the attached LIC 9099D.  An exit interview was conducted with Wellness Director Camille Nero and a copy of this report, along with Licensee/Appeal Rights (LIC 9058 01/16), were provided. Their signature confirms receipts of these documents.

    87224(a)(4) "The licensee may evict a resident for one or more of the reasons listed in…Thirty (30) days written notice to the resident is required…the reappraisal believe that the facility is not appropriate for the resident." This requirement was not met, as evidenced by: Based on records and interviews: Licensee evicted 1 out of 1 residents based on inability to meet their needs, without issuing them 30 days written notice. This posed a potential personal rights risk to persons in care.
