What the inspector wrote

Interviews were conducted with three (3) residents. All residents interviewed denied that staff had gone through their personal belongings without consent. Several residents stated they felt their privacy was respected and that staff only entered their rooms for routine care or housekeeping, with notice or permission. Interviews with three (3) staff members revealed that staff were aware of residents’ rights to privacy and personal property. Staff denied going through any resident’s belongings without permission and stated they only access resident property when necessary and with consent, such as during room cleaning or when assisting with grooming and hygiene. An outside source, reported no concerns regarding staff conduct related to residents’ personal property. A review of facility policies confirmed that staff are trained on residents’ rights, including the right to privacy and control over personal possessions, in accordance with Title 22, Section 87468(a)(6), which states that residents have the right to be free from unreasonable searches and to possess and control their own personal property. Staff training records showed that all staff received training on resident rights and privacy protections during orientation and annually thereafter. During the visit, staff were observed knocking before entering resident rooms and interacting respectfully with residents and their belongings. The Department has investigated a complaint with the above allegations. The Department has found that there is not a preponderance of evidence to prove that the alleged violation occurred; therefore, the allegation is unsubstantiated . An exit interview was conducted with Lisa Sayre, Administrator,  to whom a copy of this report and the Licensee/Appeal Rights (LIC9058 03/22) were provided.
