This posed an immediate safety risk to 75 of 75 residents [Resident #1 (R1) through Resident #75 (R75)] in care.

Report specified resident events within seven days

87211(a)(1): A written report shall be submitted to the licensing agency and to the person responsible for the resident within seven days of the occurrence of any of the events specified in (A) through (D) below.This requirment is not met as evidenced by: Based on file review and interviews, the Licensee did not ensure submission of incident reports to the Department were within the required timeframe, posing a potential health, safety, and personal rights risk to 76 out of 76 residents in care.

Right to freedom from abuse and neglect

87468.2 Additional Personal Rights of Residents in Privately Operated Facilities (a)In addition to the rights listed in Section 87468.1, Personal Rights of Residents in All Facilities, residents in privately operated residential care facilities for the elderly shall have all of the following personal rights:(8) To be free from neglect, financial exploitation, involuntary seclusion, punishment, humiliation, intimidation, and verbal, mental, physical, or sexual abuse.This requirement was not met as evidence by: Based on interviews and review of records, the licensee did not ensure R1 was free of neglect resulting in pressure injuries, which posed a potential health, safety and personal rights risk to 1 (R1) of 71 residents in care.

Maintain cleanliness and prevent incontinence odors

87625 Managed Incontinence (b) In addition to Section 87611, General Requirements for Allowable Health Conditions, the licensee shall be responsible for the following: (3) Ensuring that incontinent residents are kept clean and dry and that the facility remains free of odors from incontinence. This requirement was not met as evidenced by: Based on review of records, and interviews, the licensee did not ensure incontinent residetns were kept clean and dry, which posed a potential health, safety, and personal rights risk to 3 residents in care.

Clean linen quantity and hygiene supplies

87307 Personal Accommodations and Services (a) (3)(C)Clean linen, including blankets, bedspreads, top bed sheets, bottom bed sheets, pillow cases, mattress pads, bath towels, hand towels and wash cloths. The quantity shall be sufficient to permit changing at least once per week or more often when indicated to ensure that clean linen is in use by residents at all times...This requirement was not met as evidenced by: Based on review of records and interviews, the licensee did not ensure residents had clean linens at all times, which posed a pontential health, safety, and personal rights risk to residents in care.

(b) Clients shall be assisted as needed with self-administration of prescription and nonprescription medications.This requirement is not met as evidenced by: Based on file review and interview, the Licensee did not ensure proper medication administration procedures, resulting in a medication error, posing a potential health and safety risk to 1 out of 71 residents in care.

Ensure hazardous items are locked and not unattended

(a) . . . the licensee shall ensure that disinfectants, cleaning solutions, poisonous substances . . . and other similar items which could pose a danger to residents are in locked storage and are not left unattended . . .This requiement is not met by: Based on file review and interviews, the Licensee did not ensure hazardous cleaning supplies were kept locked and inaccessible to residents in care, posing an immediate health and safety risk to 1 out of 71 persons in care.

Dignity in personal relationships

87468.1 Personal Rights of Residents in All Facilities(a) Residents in all residential care facilities for the elderly shall have all of the following personal rights: (1) To be accorded dignity in their personal relationships with staff, residents, and other persons. This requirement was not met as evidenced by: Based on review of records and an interview, the Licensee did not ensure S1 accorded R1 with dignity in their relationship, which posed a potential health, safety and personal rights risks to residents in care.

Assist residents with self-administered medication

87465 Incidental Medical and Dental Care: “(a)(4) The licensee shall assist residents with self-administered medications as needed.” This requirement was not met, as evidenced by: Based on records and interviews, the licensee did not assist 1 of 64 residents (R1) with self-administered medications as needed/prescribed, which posed a potential health risk to persons in care.

Maintain facility in clean, safe, sanitary condition

MAINTENANCE AND OPERATION: (a) The facility shall be clean…at all times… This requirement is not met as evidenced by: Based on observation, interview, and record review the licensee did not keep the facility clean in 62 of 62 persons in care which poses a potential Health and Personal Rights risk.

PERSONAL ACCOMMODATIONS AND SERVICES: (a)…The following provisions shall apply: (3) Equipment and supplies necessary for personal care and maintenance of adequate hygiene practice shall be readily available to each resident… Based on observation and interview the licensee did not have sufficient supplies in 62 of 62 persons in care which poses a potential Personal Rights risk.

1569.317 Absentee Notification Plan for Missing Residents: “Every residential care facility for the elderly…shall, for the purpose of addressing issues that arise when a resident is missing from the facility, develop and comply with an absentee notification plan…” This requirement was not met, as evidenced by: Based on records and interviews, licensee’s staff did not comply with the facility’s absentee notification plan for 1 of 71 residents (R1), which posed a potential safety risk to persons in care.

1569.699 Exit doors; egress-control devices of time-delay type; fences: "(a)(7)(A) A sign shall be provided on the door located above and within 12 inches of the panic bar or other door-latching hardware reading: 'KEEP PUSHING. THIS DOOR WILL OPEN IN __ SECONDS. ALARM WILL SOUND..'" This requirement was not met, as evidenced by: Based on observation, licensee did not provide signs meeting regulatory requirements on its delayed-egress doors, within an area of the facility where 24 of 71 residents (Resident #1 through Resident #24) resided, which posed a potential safety risk to persons in care.

87303 Maintenance and Operation: “(i)(1) All facilities licensed for 16 or more and all residential facilities having separate floors…shall have a signal system which shall: (A) Operate from each resident’s living unit.” This requirement was not met, as evidenced by: Based on observation and interview, licensee did not have a signal system which operates from each resident's living unit, within an area of the facility where 24 of 71 residents (Resident #1 through Resident #24) resided, which posed a potential safety and personal rights risk to persons in care.

87705 Care of Persons with Dementia: “(j) The licensee shall have an auditory device or other staff alert feature to monitor exits, if exiting presents a hazard to any resident.” This requirement was not met, as evidenced by: Based on records and interviews, the licensee did not have an auditory device or other staff alert feature to monitor exits, which posed a potential safety risk to 1 of 71 residents (R1) in care.
