What the inspector wrote

On 03/29/2021, from 12:47pm to 1:18pm, Licensing Program Analyst (LPA) Rachel De Leon conducted the initial complaint visit. Due to the situation surrounding the Coronavirus Disease 2019 (COVID-19), and to implement mitigation measures, the complaint visit was conducted virtually by FaceTIme with CEO/Administrator Chris Quattlebaum. LPA De Leon explained the purpose of the visit and requested copies of pertinent documents relevant to the investigation. LPA De Leon determined further investigation was needed. On 05/05/2021, Investigator Rippe reviewed the Atascadero Police Report #21-0774. The report stated on 03/31/2021, R1 had a forensic interview and stated S1 touched R1’s chest one time. R1 stated R1 touched S1’s penis and that S1 wanted R1 to touch it and if felt good. Investigator Rippe asked R1 if R1 was okay with S1 asking R1 to touch S1’s penis and R1 responded by saying “I’m 61 years old”. R1 stated R1 didn’t tell anyone about the incident. However, on 03/25/2021, R1 told the House Manager (S2) about the alleged incident. Investigator Rippe conducted interviews with S2 on 05/05/2021 at 9:07am and on 05/06/2021 at 11:28am and 12:04pm; on 05/06/2021 with R1 at 11:41am; with R2 at 11:46am; with R3 at 11:55am; with R4 at 12:01pm; email contact with the CEO/Administrator on 05/06/2021 and 05/11/2021; on 06/02/2021 with S3 at 1:40pm; and with S1 at 2:26pm. Information obtained through Investigator Rippe’s interviews found that R1 got along well with S1 and never reported any concerns regarding S1 prior to the 03/25/2021 allegation. S1 denied inappropriately touching R1 or R1 touching S1. Staff interviewed had never witnessed S1 touch any of the residents inappropriately or any resident touch S1 inappropriately. R1’s physician report stated R1 is diagnosed with behavioral/aggressive personality disorder and stated occasionally R1 is socially inappropriate. On 03//31/2021, Atascadero Police Department, Detective Scott Pipan informed Investigator Rippe that their investigation had been completed and no charges were filed against S1. Based on the information and documentation obtained and reviewed, the Department does not have sufficient evidence to support the above allegation. Therefore, the above allegation is deemed Unsubstantiated at this time. Exit interview, copy of report given.
