What the inspector wrote

At approximately 09:15 AM Licensing Program Analyst Star Stevenson arrived unannounced for a case management visit and was greeted by staff Mary Ann Ordono who called licensee Charmaine Mendaros, who gave Mary Ann Ordono permission to sign for today's case management visit. The purpose of today's visit was to discuss a violation of residents rights including use of video cameras facing private areas, as well as, video cameras inside the facility recording audio information. Licensee was advised of the requirement to avoid any audio recording inside a care facility, as well as the requirement to avoid videograpy in private areas. Licensee was given copies of regulations and asked to ensure policy is followed at all of their licensed facilities. Section 87468.2(a)(1) Type B deficiency cited. Deficiencies are cited from the California Code of Regulations (CCRs), and/or the Health and Safety Code. Failure to correct the cited deficiency(ies), on or before the Plan of Correction (POC) due date, may result in a civil penalty assessment. Th is report was reviewed with caregiver Mary Ann Ordono and Appeal rights were given.

This requirement is not met as evidenced by: Based on LPA and lIcensee observation and interview, the licensee did not comply with the section cited above in that video surveillance with audio was found facing private rooms which poses a potential health, safety or personal rights risk to persons in care.
