FAQ

Frequently asked questions

Answers based on public CCLD data and regulation text. May not reflect recent changes.

What is an administrator qualification violation in an assisted living facility?
An administrator qualification violation happens when the person managing your RCFE does not meet the specific requirements outlined in Title 22, Section 87405(d). This includes lacking the necessary continuing education units, failing the background check, or missing the required certification. If the licensee acts as the administrator, they must also meet all these identical standards.
How common are administrator qualification citations in California RCFEs?
According to CCLD inspection records, 26 California RCFEs received citations for administrator qualification issues, totaling 29 citations across 12 counties. Sacramento and Orange counties saw the highest concentration of these deficiencies. This is a Type B violation, meaning it poses a potential risk to residents if the administrator lacks the knowledge to manage the community safely.
What happens if my RCFE is cited for an unqualified administrator?
The facility will receive a Type B citation and must submit a plan of correction to CCLD. You will have to prove that the current administrator is working toward compliance or hire a qualified replacement. These citations carry civil penalties and reflect poorly on your operational management. Repeat offenses can lead to increased scrutiny of your overall staffing and care practices.
How do I fix or prevent an administrator qualification violation?
Maintain a dedicated compliance folder for your administrator that includes their initial certifications, college transcripts, and continuing education records. Audit this folder annually to verify they have completed the required hours for their certification renewal. If you act as both licensee and administrator, ensure you hold yourself to the exact same documentation standards.
Does hiring an unqualified administrator affect my facility license?
Yes, operating without a qualified administrator directly threatens your RCFE license. CCLD requires a qualified manager on duty at all times to protect resident safety. If your administrator is found unqualified, Licensing Program Analysts will demand immediate corrective action. Failure to fix the staffing gap can result in a temporary manager being appointed by the state.
