FAQ

Frequently asked questions

Answers based on public CCLD data and regulation text. May not reflect recent changes.

What is a Section 87507(e) violation?
Title 22, Section 87507(e) requires California assisted living facilities to give residents a copy of the signed admission agreement immediately after signing. Any later modifications to the contract also require immediate distribution of the updated signed copy. This rule ensures residents and their representatives have full access to the terms of their care and housing.
How common is this violation in California assisted living?
Public CCLD inspection data shows 25 California RCFEs were cited for failing to provide agreement copies. The violation is classified as Type B, indicating a potential risk to resident rights. It accounted for 27 total citations across 15 counties. Los Angeles had the highest concentration with 8 affected facilities.
What happens if an RCFE is cited for not providing agreement copies?
The California CCLD issues a Type B citation and requires the operator to provide the missing copies immediately. The community must also submit a plan of correction to prevent future documentation lapses. While Type B citations carry lower civil penalties than Type A, they still create a public record of noncompliance that families can see.
How do I fix or prevent an admission agreement copy violation?
Give the resident or their representative a copy of the admission agreement the moment it is signed. Keep a signed receipt in the resident's file proving the document was distributed. When updating care plans or fees, provide the amended agreement immediately. This simple handoff process takes five minutes and prevents a common documentation error.
Does failing to provide agreement copies affect my RCFE license?
A single Type B citation might not put your license in immediate jeopardy, but a pattern of documentation failures will draw attention from Community Care Licensing. Properly managing admission paperwork is a core administrative requirement. Maintaining strict record-keeping practices protects your license from recurrent complaints regarding resident rights and access to information.
