FAQ

Frequently asked questions

Answers based on public CCLD data and regulation text. May not reflect recent changes.

What is a facility supervision violation under Section 87205(a)?
A facility supervision violation means the licensee failed to actively oversee the assisted living community's operations and establish proper policies. Title 22, Section 87205(a) requires licensees to maintain general supervision over all facility affairs. Without active oversight, staffing gaps and safety risks go unaddressed. Operators must set and enforce policies that conform to regulations and protect resident welfare.
How common are facility supervision violations in California assisted living?
According to California CCLD inspection records, 35 RCFEs were cited for this deficiency, accounting for 45 total citations across 15 counties. Orange County led with 8 cited facilities, followed by San Mateo and Sacramento with 4 each. This is classified as a Type A citation, meaning it poses a direct and immediate risk to resident health and safety.
What happens if an RCFE is cited for lack of facility supervision?
CCLD issues a Type A citation when a licensee fails to supervise facility operations, indicating a direct and immediate risk to residents. Type A citations carry higher civil penalties than Type B and require immediate correction. A Licensing Program Analyst will conduct a follow-up inspection to verify corrective action. Repeated citations can lead to provisional licensing or facility closure.
How do I fix or prevent a facility supervision citation?
Establish written policies covering all facility operations and review them with staff quarterly. Designate a responsible person to oversee daily operations when the licensee is absent. Document supervisory activities, including regular walkthroughs and staff meetings. LPAs check for evidence of active oversight during every inspection, so maintain a dated log of supervisory actions and policy reviews.
Does a facility supervision violation affect my RCFE license?
Yes. CCLD tracks all citations on your facility's public record. Multiple Type A citations for lack of supervision can lead to a non-compliance conference, provisional license status, or denial of license renewal. California Health and Safety Code Section 1569.49 gives CCLD authority to take enforcement action against facilities with repeated supervision failures.
