FAQ

Frequently asked questions

Answers based on public CCLD data and regulation text. May not reflect recent changes.

What is protection from punishment and intimidation in an RCFE?
It is a resident's right to be free from punishment, humiliation, intimidation, abuse, and other punitive acts, such as withholding a resident's money or interfering with eating, sleeping, or using the bathroom. Title 22, Section 87468.1(a)(3) makes this a core personal right in every California assisted living facility. Because the harm is direct and immediate, CCLD treats violations as Type A, the most serious deficiency class.
How common is this violation in California assisted living?
According to California CCLD inspection records, 207 California RCFEs have been cited under Section 87468.1(a)(3), with 239 total citations across 29 counties. This is a Type A violation, the class CCLD reserves for direct and immediate risk to residents. Los Angeles County records the most citations at 45, followed by Sacramento with 23. About 1.6% of California RCFEs carry this deficiency.
What happens if an RCFE is cited for punishing or intimidating a resident?
Because this is a Type A citation, a Licensing Program Analyst documents the violation, requires an immediate plan of correction, and often returns for an unannounced follow-up. Type A citations carry higher civil penalties than Type B and can trigger a complaint investigation. Serious or repeated findings put your license at risk and may prompt CCLD to interview residents and staff directly.
How do I prevent punishment and intimidation citations?
Train every staff member that withholding food, money, sleep, or bathroom access is never an allowed response to difficult behavior. Build a written behavior-support policy a Licensing Program Analyst can review. Investigate resident complaints in writing and document your response. Post resident rights where residents and families can see them, and give staff a clear, blame-free way to report concerns.
Does this citation affect my RCFE license?
Yes, more than most. As a Type A personal-rights violation, California CCLD weighs it heavily at renewal and in any complaint review. A confirmed pattern of punishment or intimidation can lead to a temporary suspension or revocation. Correcting the deficiency quickly, retraining staff, and documenting the changes is the fastest way to keep one citation from escalating into formal enforcement.
