FAQ

Frequently asked questions

Answers based on public CCLD data and regulation text. May not reflect recent changes.

What is supervision near heating and water hazards in an RCFE?
Title 22, Section 87307(e) requires California RCFEs to supervise residents near heating appliances, hot water sources, and similar hazards based on each resident's appraisal. This rule protects residents who may not recognize the danger of hot surfaces or scalding water. An LPA checks whether staff are present and attentive when residents are near these hazards during the facility walk-through.
How common are heating and water hazard supervision citations in California assisted living?
36 California RCFEs were cited for this violation, classified as Type A because it poses a direct and immediate risk to residents. The citations span 13 counties, with Los Angeles (6) and Ventura (5) accounting for the most. According to California CCLD inspection records, this deficiency appears most often during annual inspections when LPAs observe unsupervised residents near hot surfaces.
What happens if an RCFE is cited for a heating and water hazard supervision violation?
A Type A citation means the violation creates a direct and immediate risk to resident safety. CCLD requires the facility to correct the hazard immediately, typically within 24 hours. Type A citations carry higher civil penalties than Type B citations and trigger a follow-up inspection by an LPA to verify correction.
How do I fix or prevent a heating and water hazard supervision citation in my RCFE?
Review each resident's appraisal to identify who needs supervision near heating and water hazards. Post clear staffing assignments so caregivers know which residents require monitoring during baths or when near space heaters. Conduct a monthly walk-through of all heat sources and water fixtures to confirm supervision protocols are being followed consistently.
Does a heating and water hazard supervision citation affect my RCFE license?
Yes. Repeated Type A citations for inadequate supervision near hazards can trigger a compliance review by CCLD. If the facility does not correct the deficiency, CCLD may place the license on conditional status or pursue revocation proceedings under Health and Safety Code section 1569.49 enforcement provisions.
