What providers tell us about this citation

Based on community experience, not official guidance.

Before you accept one more resident than your floor plan was approved for, picture the LPA measuring shared space and bedroom privacy. Overcrowding is an easy Type B write-up that turns into a follow-up visit. Keep your room use matched to your license and your population count honest.

FAQ

Frequently asked questions

Answers based on public CCLD data and regulation text. May not reflect recent changes.

What is a living accommodations violation under Section 87307(a)?
This violation occurs when an RCFE's living space or grounds no longer fit the facility's licensed function or fail to give residents comfortable, private accommodations. Title 22 Section 87307(a) expects the building to be large enough for the people who live and work there. CCLD most often issues this as a Type B citation, meaning the problem could become a risk to residents if it is not corrected, even when no immediate harm has occurred yet.
How common is this violation in California assisted living?
It is a steady source of facility operations findings across the state. California CCLD inspection records show 111 California RCFEs were cited under Section 87307(a), most as Type B deficiencies for a potential risk that needs correction. Los Angeles County recorded 25 citations, with Orange at 19 and Riverside at 15. The spread across 18 counties shows that crowding and space mismatches are not limited to any single region or facility size.
What happens if an RCFE is cited for a living accommodations problem?
The LPA documents the deficiency and sets a deadline to correct it, then returns to confirm the space again fits residents and the licensed function. As a Type B citation, it is treated as less severe than a Type A but still carries civil penalties and must be fixed on schedule. Ignoring it can let a potential risk become an immediate one, which raises the citation to a more serious class on the next visit.
How do I fix or prevent living accommodations citations?
Keep your resident count matched to the space your license was approved for, and resist the pull to add one more bed than the floor plan supports. Walk each shared room and bedroom and confirm residents have reasonable privacy and room to move. If you change how a room is used, check it still fits your licensed function before residents rely on it. Review space against census every time your population grows.
Does a living accommodations citation affect my RCFE license?
It can, especially if the space problem points to operating beyond your approved capacity. A single corrected Type B citation usually does not threaten a license, but it joins your public inspection record where families and placement professionals can see it. A pattern of accommodation or capacity findings signals to Community Care Licensing that the facility is stretched, which can lead to closer review at renewal. Correcting it quickly keeps the record clean.
