FAQ

Frequently asked questions

Answers based on public CCLD data and regulation text. May not reflect recent changes.

What is a false or misleading statement violation in an RCFE?
Title 22, Section 87207 prohibits California RCFEs from making or spreading false claims about their facility or services. This rule ensures residents and families make decisions based on accurate information. Operators must carefully review all marketing materials, website descriptions, and verbal claims for complete accuracy before sharing them with the public.
How common are false statement citations in California assisted living?
As of recent data, 98 California RCFEs were cited for this violation. This represents 0.74 percent of facilities. The state classifies this as a Type A citation because misinformation poses a direct and immediate risk to residents. Most citations occur in Los Angeles and Orange counties.
What happens if an RCFE is cited for false or misleading statements?
The California CCLD issues a Type A citation when an operator makes false claims about their community. Type A citations carry higher civil penalties than Type B deficiencies. The facility must submit a plan of correction and remove the misleading information immediately. Failure to act can lead to additional follow-up visits from Licensing Program Analysts.
How do I fix or prevent a false statement citation?
Audit all brochures, website content, and advertising to ensure claims match your actual services and license capacity. Train staff to give accurate information during facility tours. Ensure no one promises medical care or specialized memory care unless the facility is explicitly licensed for it. Regular reviews of your public-facing materials prevent accidental misrepresentations.
Does a false statement citation affect my RCFE license?
Yes. Repeated or severe violations of Health and Safety Code section 1569.44 and Title 22 can trigger increased CCLD oversight. The state may place your facility on probation or revoke your license if misleading statements continue. Correct the issue promptly to protect your license status.
