FAQ

Frequently asked questions

Answers based on public CCLD data and regulation text. May not reflect recent changes.

What is a records available for inspection violation?
Title 22, Section 87506(d) requires your assisted living facility to make all resident records available for CCLD to inspect, audit, and copy upon demand during normal business hours. When an LPA arrives and records are disorganized, missing, or inaccessible, the facility receives a Type B citation. This matters because incomplete records can delay care decisions and leave residents vulnerable. Keeping records organized protects both your residents and your license.
How common is a records available for inspection violation in California assisted living?
According to California CCLD inspection records, 52 California RCFEs were cited for Section 87506(d) violations. These are classified as Type B citations, meaning the deficiency poses a potential rather than immediate risk to residents. Riverside and Contra Costa counties each had 10 cited facilities. This represents 0.39% of California RCFEs. LPAs check record access on nearly every visit, so unprepared facilities are regularly caught.
What happens if an RCFE is cited for records not available for inspection?
A Type B citation under Section 87506(d) requires your facility to submit a written plan of correction to CCLD by the deadline the LPA specifies. Type B citations carry civil penalties, though lower than Type A citations. If the same deficiency recurs, enforcement escalates. CCLD may schedule a follow-up inspection to verify compliance. Multiple unresolved record-access violations can trigger broader reviews of your facility operations.
How do I fix or prevent a records available for inspection citation?
First, designate one staff member responsible for organizing all resident records. Second, store records in a central, accessible location that LPAs can reach during business hours. Third, maintain a current log of every resident file and its location. Fourth, run monthly audits to confirm no files are missing or incomplete. Experienced administrators complete these audits in about 30 minutes per month and avoid surprise citations.
Does a records available for inspection violation affect my RCFE license?
A single Type B citation under Section 87506(d) will not immediately jeopardize your RCFE license. However, CCLD tracks repeat deficiencies across inspections. A pattern of record-access violations signals administrative neglect and can factor into licensing decisions at renewal. If your facility accumulates unresolved citations across multiple code sections, CCLD may place you on a compliance review schedule. Correcting record-access issues promptly protects your standing.
