What the inspector wrote

On 7/18/25 at 10:18am, Licensing Program Analyst (LPA) Briana Plumboy met with Assistant Director Martha Garcia for the purpose of an UNANNOUNCED COMPLAINT INSPECTION. Present for this inspection was 53 preschool age children in care and 11 staff. The allegations a staff violated a child's personal rights and the facility failed to report an unusual incident have been SUBSTANTIATED. Based on LPA's interview and file review, a staff member whom worked at the facility violated a child's personal rights, and on a separate occasion law enforcement was contacted and onsite at the facility regarding the same staff member. The facility conducted an investigation and the staff member was released from her duty as a teacher/staff member. The preponderance of evidence standards have been met, therefore the above allegations are found to be SUBSTANTIATED. Title 22, Division 12, Chapter 1, Sections 101223(a)(1) and 101212(d) are being cited on the attached LIC. 9099D. A notice of site visit was given and must remain posted for 30 days. Appeal Rights were given and discussed. An exit interview was conducted.

    REPORTING REQUIREMENTS

    (d) Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. This requirement was not met as evidence by:Based on interview and record review, the Director did not report the incident or law enforcement presence at the facility which poses a potential health and safety risk to children in care.

    (a) The licensee shall ensure that each child is accorded the following personal rights:(1) To be accorded dignity in his/her personal relationships with staff and other persons.
