What the inspector wrote

On May 29, 2026, at 2:00pm, Licensing Program Analyst (LPA) Randy Miranda arrived unannounced for an annual inspection for compliance to health and safety. Present for the inspection was the program supervisor, 6 teachers, 4 teacher’s aide, and 44 school age children. The site director was out for the day. Adventure Time Maloney currently operates during the regular school year from Monday-Friday 7:00AM-8:30AM and 11:30AM - 6PM. Summer Break hours are Monday – Friday, 7am – 6pm. Conditions of licensure: Age Range; Kindergarten through 6 th grade. Operating out of Portable and Multipurpose Room. Total capacity is 115. Adventure Time Maloney operates in a single-story portable classroom on the Maloney Elementary School campus. A fire clearance for 115 children was granted By the Fremont Fire Department on May 13, 2025. Because the School Age Program operates on a functioning school site, it is exempt from requirements related to indoor and outdoor square footage, toilets, fencing, and isolation space pursuant to Health and Safety Code Section 1596.806. Outdoor activities take place on the playground and large blacktop area, both of which are in safe condition and free of sharp, loose, or pointed hazards. Areas around and beneath high-climbing equipment are cushioned with appropriate material to absorb falls. Shade is provided by building eaves and nearby trees, and staff maintain continuous supervision during outdoor play. Sign-in and sign-out sheets were reviewed and verified, confirming that all signed-in children were present. Classrooms contain trash cans with tightly fitting lids for proper waste disposal. The campus has separate boys’ and girls’ restrooms, each equipped with functioning sinks, handwashing signage, and adequate soap and towel supplies. All toilets, sinks, and cleaning areas are maintained in safe and sanitary conditions. During Summer Break, staff restrooms are locked; therefore, staff will use the children’s restrooms while ensuring children are not present during adult use. Fresh drinking water is available through a water fountain, a water cooler inside the portable classroom, and children’s personal water bottles. The facility is equipped with two fully charged 3A40BC fire extinguishers mounted near the left and right entrances. The most recent fire system inspection was conducted by Fremont Alarm on September 8, 2025. The carbon monoxide detector was tested and found to be fully functional. Disaster drills are conducted at least every six months; the last fire drill occurred on January 6, 2026, and the most recent earthquake drill occurred on January 14, 2026. Heating and ventilation in the classroom are adequate, and all required postings are displayed on the walls. The facility is clean, organized, and furnished with age-appropriate equipment. Surfaces, including floors and countertops, are free of toxins. Hazardous materials and chemicals are stored securely in a locked cabinet. No bodies of water are accessible to children. The center provides snacks, while children bring lunches from home. Dry goods and canned foods were reviewed and found to be within their expiration dates. Both children and staff use the school restrooms, with designated facilities available for staff. Children’s and staff files were reviewed and found complete and well organized. All individuals subject to criminal background checks have received the required clearances. Site Director was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For childcare center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP). This facility operates out of a portable classroom that does not have any water lines to the building. Children bring their own water bottles, and the school also provides bottled water to children. Lead testing is complete and documented. This facility provides Incidental Medical Services – IMS.
