What the inspector wrote

On August 17, 2023 at approximately 9:30am, LPA Haderer arrived unannounced for an annual inspection for compliance to Health and Safety. Present for the inspection was the site director Malalay Mogaddedi, teacher Mehwish Burney and four children in care. During the inspection, an additional teacher, Kim Costa and additional children arrived. The hours of operation remain 7:00am to 6:00pm. The facility is a single portable room operated on the campus of Olivera elementary school. Children use the school playground yard and grass area. Everything is in safe condition and free from sharp, loose or pointed parts and the areas around or under high climbing equipment has appropriate cushioned material that absorbs a fall. Shade was available in the play areas and teachers are always present. The facility has 2 fully charged 3A40BC fire extinguishers by the main door and westerly exit. The last annual inspection was done 8/18/2022. There is a working carbon monoxide detector (tested and working). Disaster drills are conducted at least once every month, the last drill was conducted May 16, 2023. The facility is clean and well organized with ample age appropriate furnishings and equipment. Surfaces including floors and counter tops are clean and toxic free. There were no hazardous items/toxins observed to be accessible to children in care today. There are no bodies of water accessible to children in care. Heating and ventilation is acceptable. Posted documents include: License; snack menu; daily schedule; emergency disaster plan; Parent\342\200\231s Rights\342\200\231 Personal Rights; seatbelt laws. There are children\342\200\231s restroom facilities on campus with two toilets and three sinks (girls) and one toilet, two urinals and two sinks (boys). The sinks have functioning water taps with appropriate hand washing signs. There are enough towels and soap supplies. All toilets, handwashing and cleaning areas are in safe and sanitary operating condition. Children's records were reviewed: LPA requested and reviewed facility roster. Some required licensing forms for children admitted to school this week (school opened one day ago) were not completed and/or signed by parents \342\200\223 see LIC809D for deficiency . Staff files were reviewed. All staff subjected to criminal review have been cleared and associated to the facility. All staff have current Mandated Reporter certificates, CPR/1 st aid certificates were current. At least one staff opening and closing has valid CPR/1 st Aid certificates. Classrooms have trash cans with tight fitting cover for the disposal of solid waste. Children bring their own water bottles and tap water is also available inside and outside the classroom. Lead testing for the facility has not been completed (see below). Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For childcare center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP). LPA verified that the lead testing was completed in accordance with the Written Directives outlined in PIN 21-21.1-CCP. \342\200\242 CCC DID NOT COMPLETE TESTING PRIOR TO THEIR DEADLINE \342\200\223 see LIC809D for deficiency This facility provides Incidental Medical Services \342\200\223 IMS. LPA reviewed storage of \342\200\234medication and equipment/supplies, and reviewed children\342\200\231s, personnel, and administrative records. For IMS information see PIN 22-02-CCP. Licensee was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. There were 2 deficiencies issued during today\342\200\231s inspection, see LIC809D for details . - Lead testing of water has not been completed - Some licensing forms for children\342\200\231s files were not completed and/or signed by parents See 809D for deficiencies cited today. Failure to correct will result in a $100 per day civil penalty until corrected. Repeat violations are $250 per violation and $100 per day until corrected. **Please see LIC 9102 for Advisory Notes . A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the Site Director Malalay Mojaddedi.
