What the inspector wrote

On 2/10/26, Licensing Program Analyst (LPA) Briana Plumboy met with Director Catalina Garcia for an unannounced case management inspection. The center was toured. Present for the inspection was 6 staff as well as 34 preschool age children. LPA Plumboy conducted an unannounced case management visit to follow up on a self reported unusual incident. The attached type A deficiency is cited today and must be corrected by the due date. Upon receipt, director shall post this report for 30 days and provide copies of this licensing report to parent/guardians of children in care at the facility and to parent/guardians of children newly enrolled at the facility during the next 12 months. LIC 9224 Acknowledgement of Receipt of Licensing Reports should be signed by guardians and placed in each child’s file. An exit interview was conducted. Appeal rights provided and discussed. Exit interview was conducted and report was reviewed with Director Catalina Garcia.

    To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirement was not met as evidence by: a staff member was observed pulling a child in care by the back of his collar and proceeded to kick him at least 3 times while directing him to the carpet which posed an immediate risk to the health, safety, and personal rights to persons in care.
