What Happened
Two critical compliance violations documented same day. Type A citation issued for immediate risk to children (violation details documented separately). Follow-up case management visit found licensee does not reside in home as required; licensee ordered to surrender license or move back into home.

102370 Criminal Record Clearance(d) All individuals subject to a criminal record review... shall prior to working, residing, or volunteering in a licensed facility: (1)Obtain a California clearance or a criminal record exemption as required...This requirement is not met as evidence by: Based on observations, record review, and interviews, the licensee did not comply with the section cited above by allowing her uncleared nephew, Cheng Heng, to live in the home without an eligible criminal record clearance.
What does this citation mean? →(a) The licensee shall be present in the home and shall ensure that children in care are supervised at all times. When circumstances require the licensee to be temporarily absent from the home, the licensee shall arrange for a substitute adult to care for and supervise the children during his/her absence. Temporary absences shall not exceed 20 percent of the hours that the facility is providing care per day.This requirement is not met as evidence by: Based on interview, the licensee did not comply with the section cited above by not living in the home.
