    101439.1 Infant Care Center Sleeping Equipment (f) Cribs shall be free from all loose articles and objects, including blankets and pillows. LPA Breaux noticed during the health and safety tour, that a blanket was in an infant's crib while sleep. Which poses a potential health, safety or personal rights risk to persons in care.

    101223(a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature... This requirement was not met as evidenced by: Staff inappropriately handled a child while in care. This poses a potential risk to the health and safety of the children in care.

    101170 - Criminal Record Clearance: (e) All individuals subject to a criminal record review shall prior to working, residing, or volunteering in a licensed facility; (1) Obtain a criminal record clearance or a criminal record exemption as required by the Department. This requirement was not met as evidenced by: LPAs observed four staff members present to have no eligible clearance which is an immediate health, safety, and personal rights risk to children in care.

This requirement was not met as evidenced by:Based on interviews, it was stated they are not providing 100% visual supervison at all times to children in care which poses an immediate health and safety risk to children in care.

(1) An aide as specified in Section 101216.2 may be substituted for a teacher when all of the following criteria are met: (A) A fully qualified teacher as specified in Sections 101616.2(a) and (c) is directly caring for and supervising no more than three infants; and has overall responsibility for supervising a total of no more than 12 infants, with the assistance of three aides as specified in Section 101616.5(b)(1)(B). This requirement is not met as LPA obsevered and files reviewed that staff was not quaified. Therefore this poses a potential health and safety risk to children in care.

    101438.1(4)(a) When infants are in care, the diaper-changing area, where residue is splashed, shall be washed and disinfected after each diaper change. (a) The immediate floor and wall areas shall also be kept clean. Base on observation of the current condition of the diaper changing area,the facility did not ensure this area was clean, which poses an immediate risk to the health and safety to children in care. This is an potential risk to the Health and Safety or personal rights to persons in care.
