What the inspector wrote

On 4/9/24 at approximately 12:30pm, Licensing Program Analysts (LPAs) Briana Plumboy and Randy Miranda met with licensee Arifa Salayeva for an UNANNOUNCED ANNUAL REQUIRED INSPECTION. Present for this visit was licensee's fingerprint clear and associated husband Rahim Salayev, assistant H.Minhas, 2 infants, and 5 preschool age children. The home was toured by LPAs B.Plumboy and R.Miranda and licensee Arifa Salayeva to conduct a Health and Safety Inspection upon LPA's arrival into the facility. The facility currently operates Monday through Friday from 8:00am until 5:00pm. The home is two stories. The ON LIMIT AREAS are the 2 patio rooms, and downstairs bathroom. The children walk through the family room/dining room to go to the bathroom and licensee is aware they must be supervised at all times. The OFF LIMIT AREAS are the kitchen, dining room, family room, garage, living room, downstairs bedroom, laundry room, and entire second level of the home. There is a child safety gate located between the family room and patio room. The ISOLATION AREA will be the patio room on the right. The BACKYARD is off limits effective 4/9/24. There are toys and learning materials present during today's inspection. The licensee provided current day-care insurance to LPA Plumboy. The home has a fully charged 2A10BC fire extinguisher, working smoke detector, working carbon monoxide detector, and working telephone (all which were tested and checked during the inspection by LPA Plumboy). The licensee's CPR and First Aid certificate expired 3/12/24. LPA Plumboy reviewed the licensee's mandated reporter training certificate and found she completed the course and received a certification of completion on 4/21/22. The licensee is in compliance with the immunization law. The fireplace is screened to prevent access by children. Per licensee, there are no firearms in the home. The licensee conducts and documents fire and disaster drills twice a year with the last one conducted on 1/8/24. The facility roster was reviewed. The licensee is in ratio today. LPA Plumboy provided a packet of forms to licensee which contain the documents needed to operate a family childcare home. See 809-C for continuance Licensee Arifa Salayeva is aware she should have knowledge of all Title 22 Regulations and follow all Title 22 Regulations at all times, as well as follow manufacture guidelines for all equipment in the facility. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was encouraged to frequently visit our website at ccld.ca.gov for licensing regulations and updates. Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platforms. To receive important licensed related information to licensed facilities, visit the CCLD Important Information website at https://www.cdss.ca.gov/inforesources/community-carelicensing/subscribe and select the Child Care option to receive email communication. Licensee Arifa Salayeva was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. See 809-C for continuance Licensee Arifa Salayeva was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. LPA discussed the safe sleep regulations with licensee Arifa Salayeva and discussed the Child Care Licensing Safe Sleep webpage at: https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep , as an additional resource. LPA also informed licensee Arifa Salayeva of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at: https://www.cpsc.gov/ , and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. The attached Type A deficiency is cited today. Upon receipt, licensee shall post for 30 days and provide copies of this licensing report to parent/guardians of children in care at the facility and to parent/guardians of children newly enrolled at the facility during the next 12 months. LIC 9224 Acknowledgement of Receipt of Licensing Reports should be signed by guardians and placed in each child\342\200\231s file. During the exit interview, the Licensee Arifa Salayeva confirmed that there are no Registered Sex Offenders living in the facility. The following was cited during today's inspection: 1) The licensee is not documenting 15 minute safe sleep checks for infants 2) The licensees assistant does not have the required provider immunization's for her assistant 3) The licensee does have a current CPR/ First Aid certificate 4) 3 out of 8 children's files are missing Parents' Rights (Lic.995A) 5) C1's file is missing Lic. 700 6) Licensee's assistant does not have a mandated reporter training certificate 7) An assistant is present without a criminal record clearance A notice of site visit was given and must remain posted for 30 days. See 809-D for deficiencies cited during today's inspection. Appeal rights provided and discussed. Exit interview conducted and report was reviewed with licensee Arifa Salayeva.
