Inspector’s narrative

What the inspector wrote

During staff interviews, S2 verbally admitted during the Interview by the LPA that they indeed "yelled" at C1 and apologized to child and parents the next day. RP met with S1 the following day to advise of incident and discuss with S2. Based on admission of the allegation and interviews that were conducted by the LPA, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 Chapter 1 Article 06 Section 101223(a)(1) is being cited as a Type A Violation ,see attached LIC 9099D. LPA provided LIC9224 Center Director to give to current families by 7/26/24 and all new families for 12 months thereafter, effective 7/25/24. This report must remain on file for three years. Exit interview was conducted with Center Director Dan Kong. Appeal rights were given and discussed. Based on staff interviews that were conducted by the LPA, observations and record review, the above allegation is found to be UNSUBSTANTIATED, Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur. Exit interview was conducted with Center Director Dan Kong. Appeal rights were given and discussed. Based on admission of the allegation, photographs received/reviewed and interviews that were conducted by the LPA, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 Chapter 1 Article 06 Section 101223(a)(3) is being cited as a Type A Violation ,see attached LIC 9099D. LPA provided LIC9224 Center Director to give to current families by 7/26/24 and all new families for 12 months, effective 7/25/24. This report must remain on file for three years.     Personal Rights(a) The licensee shall ensure that each child is accorded the following personal rights: (1) To be accorded dignity in his/her personal relationships with staff and other personsThis was evidenced by: During staff interviews conducted by LPA, by way of admission, there was a verbal admission by staff that a child was not accorded dignity with a teacher, teacher yelled harshly at a child, which poses an immediate risk to the health, safety or personal rights to children in care.
