What the inspector wrote

On 05/01/2024 at 9:45AM, Licensing Program Analysts (LPAs) Jaleesa Jackson and Manel Estoesta conducted an unannounced case management visit to the facility and met with facility representative Faye Toms. Also present at the time of the visit were 7 preschool aged children and 1 infant. At 10:43AM Director Merat Ayalew arrived at the facility. At 9:45AM LPAs observed 1 infant commingled in the preschool room during circle time. Licensee does not have a waiver to commingle the two age groups. Staff stated that the infant is brought in for about an hour and a half. LPA let Director know that waivers are needed for limited commingling of the two age groups. LPA's reviewed sign in and out log and found 1 child not signed in. This is a repeat violation from the visit on 11/13/2023. LPAs reviewed the staff log and found that from 6:45AM to 8:00AM there was only 1 staff member present for 3 preschool aged children and 2 infants. The facility is out of ratio and this is a repeat violation from the visit on 4/17/2024. LPAs informed Director Merat Ayalew that in the morning the center was out of ratio and that the staff need to be adjusted for the hours of operation for both licenses. At 9:50AM LPA Jackson observed all napping equipment stacked on top of each other with the bedding on. LPA informed Director that bedding for the napping equipment need to be store separately and that the children's bedding is not to touch one another in storage. Through record review it was found that Director Merat Ayalew is listed as the Director at another facility in San Jose. LPAs informed her that she can only be the Director for one facility and needs to submit a completed director packet for one of the facilities. Continued on 809-C There were 6 deficiencies cited today. See 809-D for deficiencies. LPA Jackson informed Director Merat Ayalew that this report dated 5/01/2024 document 1 Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care. Also, LPA Jackson informed the Director to provide a copy of this licensing report dated 5/01/2024 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the Director Merat Ayalew.

This requirement is not met as evidenced by:Based on record review and interview, Licensee is operating as center director for two separated daycares, which is a potential health and safety risk to persons in care.

    101216.3(a) Teacher-Child Ratio: There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance.This requirement is not met as evidenced by: Based on observation and record review, the facility did not comply with the section cited above as the facility operated out of ratio which poses/posed a immediate health, safety or personal rights risk to persons in care.

  • SIGN IN AND SIGN OUT

    In addition to the sign-in procedure requirement... the licensee shall develop, maintain, and implement a written procedure to sign the child in/out of the child care center that shall, at a minimum, include the following: The person who signs the child in/out shall use his/her full legal signature and shall record the time of day. This requirement was not met as evidenced by:Based on record review, the facility did not comply with the section cited above in 1 out of 6 children were not signed in which poses a potential health, safety or personal rights risk to persons in care.

  • NAPPING EQUIPMENT

    Bedding shall be individually stored so that each child's bedding is identifiable and no child's used bedding comes into contact with other bedding.This requirement is not met as evidenced by: Based on observation, children's napping equipment were stack on the floor with the bedding in contact with other children's bedding, which is a potential health and safety risk to persons in care.

  • 1596.8595(a)(1)Type B

    Each licensed child day care facility shall post a copy of any licensing report pertaining to the facility that documents either a facility visit or a complaint investigation that results in a citation for a violation that, if not corrected, will create a direct and immediate risk to the health, safety, or personal rights of children in care. The licensing report provided by the department shall be posted immediately upon receipt, adjacent to the postings required pursuant to Section 1596.817 and on, or immediately adjacent to, the interior side of the main door to the facility and shall remain posted for 30 consecutive days.
