What the inspector wrote

On 3/01/2023 at 10:58am Licensing Program Analyst (LPA) Morgan Pringle arrived at the facility for an Unannounced Plan of Correction (POC) Inspection to follow up on deficiencies cited on an annual 1-year inspection conducted on 2/15/2023. LPA met with Licensee/owner Deidra Daniels. Present during the inspection was the Licensee, seven (7) toddlers and two (2) infants. Deficiencies cited on 2/15/2023 \302\267 101170(e)(1) Criminal Record Clearance \302\267 101416.5(b) Ratio NO PROOF OF CORRECTION WAS OBSERVED OR SUBMITTED ; therefore, the center is being recited for the above deficiencies. During the inspection LPA observed the following deficiencies as a result of the POC inspection: 10:58am \342\200\223 Upon arrival LPA observed Licensee alone with (1) infant and seven (7) toddlers. One (1) other infant was in the preschool room and was brought over to Licensee. 11:01am \342\200\223 Licensee went around the corner to the preschool room to talk to the preschool teachers leaving (1) infant and (7) toddlers alone in the classroom. 11:21am \342\200\223 LPA observed expired milk in the refrigerator. Expiration date of 2/27/2023. 11:22am \342\200\223 LPA observed (1) infant asleep in car seat/stroller 11:33am \342\200\223 Adult staff member Ingrid Flores Lopez arrived at the facility. LPA asked for her name and date of birth as LPA did not see her on the facilities criminal record clearance association list. LPA checked Guardian and it was found that Ingrid does not have a criminal record clearance. Ingrid was also observed providing direct care and supervision for the infants and toddlers with the Licensee. 12:05pm \342\200\223 Licensee left two (2) infants and seven (7) toddlers alone with Ingrid Flores Lopez while talking with the preschool teacher. Licensee reentered the classroom at 12:08pm. 12:54pm - LPA Pringle observed the report from the Non Compliance Conference held on 2/23/2023 was not posted and no LIC9224 Acknowledgement of Receipt of Licensing Report forms were given to parents. 2:25pm - LPA conducted record review and found that there were eight (8) unsigned Acknowledgement of Receipt of Licensing Report (LIC 9224) for the two (2) Type A citations that were received on 2/15/2023. Director was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. LPA Morgan Pringle informed licensee Deidra Daniels that this report dated 3/01/2023 document(s) three(3) Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA Pringle informed the licensee to provide a copy of this licensing report dated 3/01/2023 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with Director Deidra Daniels

  • CRIMINAL RECORD CLEARANCE

    (e) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: (1) Obtain a California clearance or a criminal record exemption as required by the Department... This requirement is not met as evidenced by: Based on observation and interview, Ingrid Flores Lopez does not have a criminal record clearance and was providing unsupervised care and supervision which poses an immediate risk to the health and safety of the children in care.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    101229(a)(1) Care and Supervision. No child(ren) shall be left without the supervision, including visual observation, of a teacher at any time except as specified in sections 101216.2(e)(1) and 101230(c)(1). This requirement is not met as evidenced by: LPA's observation of Licensee around the corner of the classroom talking to the preschool teachers, leaving (2) infants and seven (7) toddlers without supervision. This poses an immediate risk to the health and safety of the children.

  • STAFF-INFANT RATIO

    (b) There shall be a ratio of one teacher for every four infants in attendance.This requirement is not met as evidenced by:LPA observed Licensee alone with (2) infants and seven toddlers. This poses an immediate risk to the health and safety of the children.

  • 101427(c)(1)Type B

    (c) The infant shall be fed in accordance with the individual plan. (2) The infant care center shall have appropriate food available for the infant. This requirement was not met as evidenced by: LPA observed expired milk in the refrigerator. Experation date 2/27/2023. This poses a potential risk to the health and safety of the children in care.

  • INFANT CARE ACTIVITIES

    101430(a)(3)(E) If an infant falls asleep before being placed in a crib, staff shall move the infant to a crib as soon as possible. This requirement was not met as evidenced by: LPA observed Licensee place an infant in a car seat. When child fell asleep, Licensee did not move the child to a crib. This poses an immediate risk to the health and safety of the children in care

  • 1596.8595(b)(1)Type B

    1596.8595(b)(1) Notwithstanding subdivision (b) of Section 1596.859, the licensee shall post a licensing report...verifying the licensee’s... noncompliance with the department’s order to correct a deficiency ...This requirement was not met as evidenced by: LPA observed the report from the Non Compliance Conference she attended at the Oakland Regional Office on 2/23/2023 is not posted at the facility. This poses a potential risk to the health and safety of the children in care.

  • ARTICLE 2. Administration of Child Day Care Licensing

    1596.8595(c)(1) A licensed child day care facility shall provide to the parents or guardians of each child...copies of any licensing report that documents any Type A citation that represents an immediate risk to the health, safety, or personal rights of children in care... This requirement was not met as evidenced by through record review it was found that eight (8) children are missing LIC9224 Acknowledgement of Receipt of Licensing Report. This poses a potential risk to the health and safety to the children in care.
