What the inspector wrote

Based on LPA Estoesta's conducted interviews, and record review, the preponderance of evidence standard has been met, therefore the above allegation is to be SUBSTANTIATED. The licensee is in violation of Reporting Requirements 101212(d) Upon the occurrence, during the operation of the childcare center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event....... LPA Estoesta informed the Site Director that this report dated 4/16/2024 included a Type B Citation which shall be posted for 30 consecutive days as there is a potential risk to the health, safety, or personal rights of children in care. The Unusual Incident was a suspected Children’s Personal Rights Violation dated 1/23/2024, reported by a parent to the Staff. CAPE Management only reported the incident on 2/5/2024 to the Regional Office which is a potential risk to the health and safety of the children in care.
