What the inspector wrote

Centralized Application Bureau (CAB) Licensing Program Analyst (LPA) M. Domantay met with Applicant Sabrina Bhandari for the purpose of a pre-licensing inspection for an application that was received for Change of Ownership to be under a single license. Please see facility# 013423756 LIC 812 for more details. Applicant requests a preschool license to serve 12 infants ages 0 to 24 months, 32 preschool children from age two years to first grade entry, and 13 toddlers ages 18 to 36 months. The program will operate Monday through Friday from 7:30 a.m. to 5:30 p.m. There were 43 total children present during today's inspection: 24 preschoolers, 9 toddlers, and 10 infants. The fire clearance that was received was dated 12/16/22 and received on 8/30/2023 from the Berkeley Fire Department. LPA notified applicant the date on the fire clearance was insufficient based on when the fire request was submitted by the licensing department on 8/29/2023 and the fire inspector backdated the fire clearance. Applicant contacted fire inspector Shannon Shaffer-Killey and spoke to her over the phone during today's inspection. Per fire inspector Shannon she backdated the fire request because they conducted an annual fire inspection at the facility less than 6 months from when the fire request was submitted from the licensing department and granted the fire clearance based on their previous annual fire inspection. LPA notified applicant that a new fire request will need to be obtained from the fire department with a sufficient date. LPA notified applicant the fire clearance states the occupancy class is under code "E" per building code, which will limit facility to 5 children under 36 months. Per applicant she will contact the fire department to clarify their occupancy class and notify the LPA once information has been obtained. LPA notified applicant, LPA will have support staff send out an updated fire request to the fire department once applicant decides on their capacity for each program once they confirm their occupancy class with the fire department. Page 1 INDOOR ACTIVITY SPACE: There are 3 preschool areas: classroom 1, classroom 2, and classroom 4. There are 2 toddler areas: classroom 3 and classroom 4. There is 1 infant area: classroom 5. Classroom 4 will be a shared space between the toddler and preschool program with a schedule in place to ensure there is no commingling. LPA observed sufficient amount of equipment, toys, tables, chairs, cubbies, and napping mats for the toddler and preschool program. LPA observed 6 cribs in the crib/nap room of the infant classroom 5. There is a first aid kit available at the facility, indoor and outdoor. There is a separate staff restroom located inside the facility in the hall. Medications will be stored in the kitchen area in a cabinet in a locked box, which is out of children's reach. LPA observed cleaning disinfectants are appropriately stored and inaccessible to children. Applicant stated there are no poisons or firearms on the premises. LPA observed a functional carbon monoxide detector in the facility. LPA observed a electronic sign-in/sign-out system. LPA measured all classrooms/areas for each program. The total indoor classroom space for the preschool program contains a total of 1372.55 square feet, which will accommodate Applicant's request for 32 preschool children. The total indoor classroom space for the toddler program contains a total of 614.64 square feet, which will accommodate Applicant's request for 13 toddler children. The total indoor classroom space for the infant program contains a total of 514.39 square feet, which will accommodate Applicant's request for 12 infant children. There are 3 toilets and 5 sinks for the preschool children, 2 of those toilets and 3 sinks will be shared with the toddler children. There are 2 sinks for infant children in Classroom 5. Individual measurements are recorded on the Capacity Worksheet (LIC 9024). Children who become ill during the day will be isolated in classroom 4 when not in use or the office area and will use the staff restroom, if necessary. Page 2 OUTDOOR ACTIVITY SPACE: There is 2 outdoor areas on the property. Outdoor 1, Outdoor 2 (patio). The outdoor play areas are fenced with wooden fencing that is at least four feet tall. LPA observed a sufficient amount of equipment and toys. There is a play structure present in the preschool/toddler play yard area, Outdoor 1. Outdoor 1 and Play structure has pea gravel throughout the yard to cushion a child's fall. There are no bodies of water on the premises. LPA notified applicant to ensure if water tables are at all used, that they should be emptied out after ever use. LPA notified applicant to install a barrier for the water hose in outdoor 1 to be inaccessible to children. There is sufficient outdoor shading provided by trees and canopies. LPA measured the 2 outdoor activity spaces. Outdoor 1 play area contains a total of 1362.99 square feet, which will not accommodate Applicant's request for 32 children. The outdoor back patio play area contains a total of 586.62 square feet, which will not accommodate Applicant's request for 13 toddler or infant children. Individual measurements are recorded on the Capacity Worksheet (LIC 9024). A waiver must be submitted for the outdoor play areas for insufficient space and shared space between the preschool and toddler programs. Applicant is planning to have the front patio renovated to be used as additional outdoor space for children. LPA discussed with applicant that a gate/fencing should be installed that is at least 4 feet tall and should be equipped with age appropriate furniture and equipment and safe for children use. This facility plans to provide Incidental Medical Services – IMS. For IMS information, see PIN 22-02-CCP. A Plan of Operation that includes IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice) or (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: http://www.ada.gov/childqanda.htm LPA discussed the following: 100% supervision is required at all times, including in the bathroom; personal rights; inspection authority; reporting requirements; staff to children ratios and capacity; staff qualifications; and maintaining buildings and grounds. LPA discussed with Applicant any changes that may occur regarding the director or an employee acting in the director's absence must be reported to department within 10 working days. Page 3 Applicant was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated. Applicant was informed of the MyChildCarePlan.org site, a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platform. Exit interview conducted and report was reviewed with the Applicant, Sabrina Bhandari. The following items are required before a license will be issued: 1. Licensing Program Manager (LPM) final file review. 2. Updated fire clearance is received from fire department. 3. A waiver must be submitted for the outdoor play areas for insufficient space and shared space between the preschool and toddler programs. 4. Updated LIC200A must be submitted by Applicant. 5. Barrier must be installed in outdoor 1 for the water hose to be inaccessible to children. 6. Planned outdoor front patio yard must have fencing/gate at least 4 feet tall and set up with age appropriate furniture and equipment. Page 4
