What the inspector wrote
On March 4, 2025, Centralized Application Bureau (CAB) Licensing Program Analyst (LPA) M. Domantay met with Director Sinian Xiao and Co Director Melanie Traynor for the purpose of a pre-licensing inspection. Applicant is requesting for a new toddler program ages 18 months to 30 months (capacity 12) and decreasing the existing preschool program ages 31 mmonths to 60 months (capacity 79). Facility is requesting to be licensed to serve a total of 91 children. The program will operate Monday through Friday from 8:00 a.m. to 5:30 p.m. Facility does not offer food for children. All food will be provided from home by families for children. LPA reviewed with applicant the LIC 311A, Records To Be Maintained At The Facility, for child\342\200\231s records, personnel records, administrative records, and documents to be posted.
LPA informed Directors Sinian and Melanie, that the facility will be converted to a single child care center license under facility number 013423790, therefore LPA will be closing the current preschool facility number 010210068. The fire clearance was granted and received on 2/4/2025 from the Berkeley Fire Department for 12 toddlers, ages 18-30 months and 79 preschoolers, ages 31 months to 60 months.
INDOOR ACTIVITY SPACE:
There is 1 indoor area for the toddler program, classroom 1, area 1 and area 2. LPA observed a sufficient amount of equipment, furniture, and toys. Per Directors they will be setting up classroom with additional toddler, age appropriate equipment and toys. LPA observed a loft area in the toddler classroom. LPA notified Director's gates must be installed at the top and bottom of the stairs to the loft area and barrier or panelling must be installed to the wooden railing in the loft area. LPA notified Director's a gate must be installed between the toddler and preschool classrooms. LPA observed a changing table in the toddler bathroom that is in hands reach of a sink. LPA notified Director's changing table must have raised sides that is at least 3 inches high. Medications will be stored in a top shelf in the toddler bathroom and in a sealed container. LPA observed a first aid kit in the toddler bathroom.

Exit interview conducted and report was reviewed with the Director Sinian Xiao and Co-Director Melanie Traynor.
The following items are required before a license will be issued:
1. Regional Manager (RM) final file review.
2. Applicant must submit photos of toddler classroom with gates installed for the loft stair area, loft paneling for railing, gate between toddler and preschool classrooms, changing table with raised sides of at least 3 inches, age appropriate equipment and toys in the toddler classroom and toddler play yard.
3. Applicant will need to submit a request for a waiver for the outdoor toddler play area to accommodate the maximum capacity of 5 toddler children outdoors at any given time with a set schedule in place.
4. Applicant will need to submit a request for a waiver for the outdoor preschool bike yard and garden yard areas to be shared with toddler program with a set schedule in place.

LPA measured indoor toddler classroom areas. The total classroom space for the toddler classroom contains a total of 471.08 square feet, which will accommodate Applicant's request for 12 toddler children.
LPA observed cleaning disinfectants are appropriately stored and inaccessible to children. Applicant stated there are no poisons or firearms on the premises. LPA observed a functional carbon monoxide detector in the preschool classroom 2 located beside toddler classroom 1 on the ceiling. LPA observed a electronic sign-in/sign-out system.
There are 2 toilets and 1 sink available for toddler children in toddler classroom 1, and a separate private restroom for the staff is located within the facility. Individual measurements are recorded on the Capacity Worksheet (LIC 9024). Children who become ill during the day will be isolated in the Director's office and will use the staff restroom, if necessary.
OUTDOOR ACTIVITY SPACE:
LPA measured the outdoor toddler program area. There is 1 toddler play yard/deck. The outdoor play area is located within the facility, surrounded by the preschool play yards, and is fenced with wooden fencing that is at least four feet tall. LPA notified Director's to send photos of age appropriate toddler equipment and toys in the toddler play yard once fully set up. There are no bodies of water on the premises. There is sufficient shading provided by canopies. LPA notified Director's that water tables must be fully emptied after every use.
The total outdoor space for the toddler play yard contains a total of 387.40 square feet, which will not accommodate Applicant's request for 12 toddler children. Individual measurements are recorded on the Capacity Worksheet (LIC 9024).
LPA notified Director's, Sinian and Melanie, Applicant will need to submit a request for a waiver for the outdoor toddler play area to accommodate the maximum capacity of 5 toddler children outdoors at any given time with a set schedule in place.
Per Director's, they would like to request toddlers have access to the preschool bike yard and outdoor garden yard with a set schedule in place between toddler and preschool programs.

LPA discussed the following: 100% supervision is required at all times, including in the bathroom; personal rights; inspection authority; reporting requirements; staff to children ratios and capacity; staff qualifications; and maintaining buildings and grounds. LPA discussed with Administrator any changes that may occur regarding the director or an employee acting in the director's absence must be reported to department within 10 working days.
Administrator was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated.
Administrator was informed of the MyChildCarePlan.org site, a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.
