What the inspector wrote

Licensing Program Analysts (LPAs) Medrano and Campos conducted an unannounced inspection in order to deliver findings on the complaint investigation for the above allegation. LPA’s met with the Director, Amanda Chio to discuss complaint allegations findings. It was alleged that the facility will commingle preschool age children with toddler age children. Based on LPA's observations and interviews conducted during the investigation, the LPA's determined that when the facility is short staffed they will combine the two programs (the preschool and the toddler program.) Therefore the allegation listed above is SUBSTANTIATED, meaning a preponderance of the evidence supports the validity of the allegation. California Code of Regulations, Title 22 101216.4(a)(2) deficiencies are being cited on the following page(s): Exit interview conducted and a copy of this report and appeal rights were reviewed and provided to Director, Amanda.

    LIMITATIONS ON CAPACITY

    101161(a) Limitations on Capacity(a) A licensee shall not operate a childcare center beyond the conditions and limitations specified on the license, including the capacity limitation. This requirement was not met as evidenced by: Based on observation and interviews, the licensee allowed children who were identified as being enrolled at another licensed facility to be present at this facility. This poses a potential health and safety risk to children in care.

    101216.3(a)(b) Teacher-Child Ratio(a) There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance. (b) The licensee may use teacher aides in a teacher-child ratio of one teacher and one aide for every 15 children in attendance.This requirement was not met as evidenced by: Based on observations made 8/6/2025 the facility was out of compliance with having S5 and S6 alone with 27 children while other staff were outside of classrooms. This poses a potential health and safety risk to children in care.

  • PRESCHOOL PROGRAM WITH TODDLER COMPONENT

    101216.4 PRESCHOOL PROGRAM WITH TODDLER COMPONENT(a) Licensees serving preschool-age children may create a special program component for children who are between 18 months and 36 months of age. The provisions of Sections 101151 through 101239.2 shall apply for children over 24 months, in addition to those specified in Health and Safety Code section 1596.955. The provisions of Sections 101351 through 101439.1 shall apply for children between the ages of 18 and 24months participating in a preschool toddler component, in addition to those specified in Health and Safety Code section 1596.955. (2)The toddler program shall be conducted in areas physically separate from those used by older or younger children. Space planning and usage for the toddler component shall be governed by the provisions of Section 101438.3. Plans to alternate use of outdoor play space must be approved by the Department. This requirement was not met as evidenced by: Based on interviews and documentation received it was found that the facility will commingle the preschool program with the toddler program when they are "short staffed." This poses a potential health and saftey risk to children in care.

  • REPORTING REQUIREMENTS

    Reporting requirements: CCR 101212(d)(1)(C)(d)Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. (1)Events reported shall include the following: (C)Any unusual incident or child absence that threatens the physical or emotional health or safety of any child. This requirement was not as evidenced by: Based on interviews and physical evidence received C1 sustained an injury resulting in hair loss that was not reported by the facility. This poses a potential health and safety risk to children in care.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    101229(a)(1)Responsibility for Providing Care and Supervision(a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1)No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not met as evidenced by: Based on observations made by LPA Placencia as well as LPA Medrano and Campos of children being left in classrooms unsupervised by an adult. This poses an immediate health and safety risk.
