What the inspector wrote

Licensing Program Analyst (LPA) Kassandra Medrano conducted a case management inspection with Director/Supervisor Tongxin \342\200\234Tom\342\200\235 Lei. The purpose of the inspection was to evaluate the proposed addition of room usage and an increase in the facility\342\200\231s licensed capacity. LPA Medrano explained the nature and scope of the inspection to Mr. Lei. A comprehensive tour of both the indoor and outdoor areas of the facility was conducted. The facility operates Monday through Friday, from 8:00 AM to 6:00 PM. The facility is requesting an increase in capacity from 50 to 88 preschool-age children, utilizing Rooms 1 through 7. The preschool program will have full access to the outdoor play yard. It was noted that the yard also functions as a parking lot. The facility representative stated that the lot is closed to vehicles by approximately 10:00 AM each day. Children are only permitted to use the space after an adult ensures the gate is closed and the area has been inspected for health and safety hazards. Indoor and Outdoor Space Measurements: Measurements were previously taken by LPA Otsuji on March 7, 2023: \302\267 Total Indoor Space: 2,697.46 square feet \303\267 35 sq. ft. per child = capacity for 77 children \302\267 Total Outdoor Space: 6,554.36 square feet \303\267 75 sq. ft. per child = capacity for 87 children A fire clearance for the requested capacity of 88 children was granted by the Alameda County Fire Department on July 21, 2025. Although fire clearance has been approved for 88 children, based on the indoor space measurements and licensing regulations, the facility does not meet the minimum square footage requirement to accommodate 88 children. Therefore, the requested increase in capacity cannot be approved at this time. Report continued on Page 2... Facility representative, was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02CCP. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For childcare center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1CCP). The facility did not complete testing prior to their deadline. LPA referred facility representative to the Department website for lead: Lead Toxicity Prevention and Water Testing Information. The facility representative indicated a prior belief that lead testing was not required, as the facility exclusively uses bottled water for drinking purposes. However, it was disclosed that the sinks are utilized for dishwashing. As of August 6, 2025, the facility has completed the required lead testing and is currently awaiting the results. LPA discussed the safe sleep regulations with facility representative and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed facility representative of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Facility representative was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. Exit interview conducted and report was reviewed with the Facility Representative, Tom. and advised them that a license for 77 preschool age children in Rooms 1-7 will be recommended for approval once the following corrections are made: 1. New Application is sent with modified capacity request 2. An updated fire clearance is received for a capacity of 77 children 3. Facility moves gate to allow use of Bathroom #3 4. Facility to install child gate to ensure no child access to storage room, there is a top lock already. 5 . Remove the room divider in Classroom #1. 6. Provide a shaded rest area for outdoor area.
