What the inspector wrote

On Monday, November 13, 2023, at 9:45 AM, Licensing Program Analyst, (LPA) Andrew Elliot and Licensing Program Manager (LPM) Mai Lor met with Applicant Ramandeep Kaur, for the purpose of an announced pre-licensing inspection. Present during this inspection is site director, Marchell McEvoy The applicant requests for an infant license to serve 8 children ages birth to two years of age. A health and safety inspection in all areas accessible to children. The program will operate Monday through Friday from 7:00 AM to 6:00 PM. The fire clearance was granted on 10/27/2023. The infant program is in the same building that serves preschool and school age children. There is one infant classroom. LPA observed one sink in classroom and one potty chair. The facility was reminded that there should be one potty chair to every five infants being toilet trained. There is one changing table with a changing pad that is at least one inch thick with raised sides that are at least three inches tall and within arm\342\200\231s reach of a sink in the classroom. There is adequate heating, lighting, and ventilation. There are no cleaning solutions, chemicals, or other hazards accessible to children. Per Applicant, there are no weapons at the facility. Applicant stated there are no medications on site; however, if medications are to be stored at the facility, the medications will be stored in the director\342\200\231s office in a locked box and inaccessible to children in care. LPA did not observe a carbon monoxide detector. LPA observed furniture and equipment to be sufficient in quantity, age appropriate and in good repair. LPA observed two highchairs in the classroom. Children have their own separate storage areas for their belongings. Drinking water is accessible to children in care via filtered water pitchers and water fountains. Parents will bring water bottles for their own children. Each children\342\200\231s water will be individually stored and labeled. Children do take naps at the facility. There are cots, bedding, and materials for the children. In addition, there is a separate crib area with 3 infant cribs for napping; however, the napping area is incomplete. The applicant acknowledges there will only be 3 crib infants at any given time. The Applicant stated the rest of the wall partition will be delivered today. Applicant stated bedding materials are washed every day by staff. There is a first aid kit available in the classroom. Applicant stated the facility will provide morning and afternoon snacks to children who can independently eat solid food, and lunch will be provided by parents. In addition, Applicant stated parents will provide all milk, formula and baby food. Per Applicant, the menu will be posted on the parent board. Applicant stated food is readily available and is in quantity necessary to meet the needs of the children in care. Staff will be responsible for milk/formula and the proper storage for each child. LPA measured the infant classroom . The indoor total measurements contain a total of 546 square feet, which will accommodate Applicant\342\200\231s requested capacity of 8 infant children. There is a separate private restroom for the staff. Children who become ill during the day will be isolated in the office area and will use the staff restroom, if necessary. There is one outdoor area on the property for the infant children and separate from the preschool outdoor space; however, the applicant is requesting to move the infant outdoor yard into the preschool yard to allow for more space. The physical separation is incomplete, and the applicant stated the additional yard fencing has been ordered. The outdoor play area is fenced with a wooden fence that is at least four feet tall. LPA observed sufficient in quantity age-appropriate equipment and toys. There are shaded areas supplied by trees and awning. The playground is free of debris and other hazards. LPA did not observe a play structure or portable climbing structure in the infant yard. There are no pools, hot tubs, or other bodies of water present. LPA measured the outdoor activity space. The outdoor total measurements contain a total of 202.6 square feet, which will not accommodate Applicant\342\200\231s request for 8 infant children. The Applicant stated she will be relocating the infant yard to increase the yard space. Emergency Disaster Plan is dated and posted for review. The facility utilizes a telephone. Applicant stated an electronic sign in and sign out process will be utilized, and paper sign in/sign out is also available. Licensee was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. LPA advised per Health and Safety Code 1597.16(a)(1) Lead Testing and PIN-21-21-CCP Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010 to test their drinking water for lead contamination between January 1, 2020 and January 1, 2023, and then every 5 years after the date of the first test. Per Written Directive 100700(c)(1) Written Directives for Lead Testing (1) For a license issued on or after July 1, 2022, initial testing results shall be received and posted within 180 days of licensure. LPA discussed the safe sleep regulations with Applicant and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed Applicant of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. LPA discussed the safe sleep regulations with applicant and discussed the Child Care Licensing Safe Sleep webpage at: https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep , as an additional resource. LPA also informed applicant of the importance of checking for recalled infant devices on the United Sates Consumer Product Safety Commission (CPSC) website at: http://www.cpsc.gov/ , and recommended they register all infant devices with he CPSC to be notified of any recalls on their purchased equipment. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN_22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. LPA reviewed with Applicant the LIC 311 A, Records to Be Maintained At The Facility, for child\342\200\231s records, personnel records, administrative records, and documents to be posted. LPA discussed 100% supervision is always required in all areas that children have access to including the bathroom. Personal Rights, inspection authority, reporting requirements,maintaining buildings and grounds was reviewed. Staff Qualifications, Staff to Children\342\200\231s ratios and Capacity was explained to ensure compliance. LPA discussed with Applicant any changes that may occur regarding the director or an employee acting in the director\342\200\231s absence must be reported to the department within 10 working days. Applicant was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California. Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platforms.
